Staff of the Court's Secretariat discussed with experts the issues of personal data protection in constitutional jurisdiction

On 23 April 2024, staff of the Secretariat of the Constitutional Court of Ukraine and the patronage services of the Court's judges participated in a workshop on the protection of personal data in constitutional jurisdiction. This is the second such event held within the framework of the joint project of the Council of Europe and the Constitutional Court of Ukraine ""Support to development of constitutional justice in Ukraine", implemented within the framework of the third phase of the joint programme of the European Union and the Council of Europe "Partnership for Good Governance" (Phase III). This workshop is the final in a series of thematic seminars and was held with the participation of representatives of the Council of Europe, national and international experts in the field of constitutional law on 19 April and 22 April this year.

The Head of the Court's Secretariat, Viktor Beschastnyi, thanked the representatives of the Council of Europe, the European Union and all international partners of the Court for their support, which is also reflected in joint professional meetings and events, during which the staff of the Court's Secretariat and the staff of the patronage services of the Court's judges exchange experience with international and national experts in the field of constitutional justice. According to him, this contributes to the enhancement of the intellectual potential of the Court's Secretariat.

As part of the event, international experts made thematic presentations, presenting their countries' practices in personal data protection.

In particular, the experience of Ireland in the European Union on data protection in constitutional jurisdiction was presented by David Erdos, PhD, Fellow in Law, Trinity Hall, Cambridge, UK, international consultant of the Council of Europe.

Kristaps Tamuż, Head of the Legal Department, Constitutional Court of the Republic of Latvia, informed about the protection of personal data in the practice of the Constitutional Court of the Republic of Latvia.

The protection of personal data in the constitutional jurisdiction in Ukraine, including familiarisation with the case materials, provision of copies of documents, data processing, was discussed in the speech of Markiian Bem, PhD in Law, attorney at law, partner at Nazar Kulchytskyy & Partners, National Consultant of the Council of Europe.

During the discussion of this issue, the participants of the event expressed their conviction that the practical recommendations provided by the respected experts will be applied in practice and will contribute to the improvement of work with personal data in constitutional proceedings. 

In conclusion, Viktor Beschastnyi thanked the experts for their thorough and informative reports, as well as the Council of Europe and the European Union, which made this and other events possible.
