 At the sessions of the Second Senate of the Court and the Board of Judges of the Court a number of rulings on certain issues were adopted

On Wednesday, April 14, the plenary sessions of the Second Senate of the Constitutional Court of Ukraine took place, at which cases upon constitutional complaints of the Public Joint-Stock Company Joint-Stock Commercial Bank ‘INDUSTRIALBANK’ concerning the constitutionality of the provisions of Article 13.3, Article 16.3 of the Civil Code of Ukraine, as well as Bohdan Bivalkevych on the constitutionality of the provision of paragraph 8 of Section XI “Final and Transitional Provisions” of the Law of Ukraine “On the National Police” were considered. The Court will proceed with consideration of these cases at one of the further plenary sessions of the Senate.

Also, based on the results of consideration of the issue of initiating constitutional proceedings in the case upon the constitutional complaint of Oleksandr Krotiuk on the compliance of the provisions of paragraph 4 of Article 284.1 of the Criminal Procedure Code of Ukraine with the Constitution of Ukraine, the Second Senate will proceed with its consideration at one of the further sessions.

In addition, the Second Senate at its session adopted a Ruling on consideration of the case upon the constitutional complaint of Oleksiy Abramovych on the constitutionality of the provisions of paragraph 2 of Article 40.2 of the Housing Code of the Ukrainian SSR in the form of written proceedings.

The Ruling was also adopted on temporary involvement of a Judge of the Constitutional Court of Ukraine to the composition of the First Board of Judges of the Second Senate which is not competent due to its composition from another Board of the same Senate.

On the same day, the First Board of Judges of the First Senate of the Constitutional Court of Ukraine held sessions for consideration of the issue of initiating constitutional proceedings.

Thus, based on the results of the session, three rulings (final) on refusal to initiate constitutional proceedings in cases upon constitutional complaints of Vasyl Bazhaniuk on compliance with the Constitution of Ukraine of part 9 of Article 295-1 of the Criminal Procedure Code of Ukraine, Veronika Golembyevska on the constitutionality of a separate provision of Article 424.2 of the Criminal Procedure Code of Ukraine, as well as Vatutine municipal production enterprise ‘Vodokanal’ on compliance of provisions of paragraph 4 of Article 332.5, paragraph 4 of Article 333.1 of the Code of Administrative Procedure of Ukraine with the Constitution of Ukraine.

Upon the constitutional complaint of Mykola Kostina on the compliance of a separate provision of paragraph 26 of Section VI “Final and Transitional Provisions” of the Budget Code of Ukraine with the Constitution of Ukraine, the Board of Judges initiated constitutional proceedings in this case. Its further consideration will take place at the session of the First Senate of the Court.
