Rulings of the Grand Chamber and the Board of Judges Adopted
Today, May 25, the Grand Chamber of the Constitutional Court of Ukraine at the in-camera part of the plenary session continued consideration of the case upon the constitutional petition of 48 People's Deputies of Ukraine on the constitutionality of provisions of paragraph 10.17 of Resolution of the Cabinet of Ministers of Ukraine "On the establishment of quarantine and implementation of enhanced anti-epidemic measures in the territory with a significant spread of acute respiratory disease COVID-19 caused by coronavirus SARS-CoV-2" of July 22, 2020 № 641 as amended. Based on the results of the consideration, the Ruling of the Grand Chamber of the Constitutional Court of Ukraine on terminating the constitutional proceedings in this case was adopted.
At the session of the Grand Chamber the issue of extending the term of adoption of rulings by the Boards of Judges of the Constitutional Court of Ukraine on initiating or refusal to initiate constitutional proceedings in cases upon constitutional complaints was considered. Following the consideration of this issue, rulings were adopted to extend the term of adoption of rulings by the Second Board of Judges of the First Senate of the Constitutional Court of Ukraine on initiating or refusal to initiate constitutional proceedings upon constitutional complaints of A. Mashchenko, V. Samotey, N. Linenko, S. Klopkov.
Rulings on extending the term of adoption of ruling by the Third Board of Judges of the Second Senate of the Constitutional Court of Ukraine on initiating or refusal to initiate constitutional proceedings in cases upon constitutional complaints of H. Bilobrov, O. Malynnykov, R. Krymus, O. Ananchenko, were also adopted. In all cases, the term was extended until June 25, 2021.
In addition, a session of the First Board of Judges of the Second Senate of the Constitutional Court of Ukraine was held in order to consider the issue of initiating constitutional proceedings in the case upon constitutional complaint of Vladyslav Duda on the constitutionality of Article 424.4 of the Code of Criminal Procedure of Ukraine. Based on the results of consideration, the ruling (final) on refusal to initiate constitutional proceedings in the case was adopted.
