Results of Work for May: 18 Sessions of the Constitutional Court of Ukraine held, 30 Acts Adopted

In May 2021, the Constitutional Court of Ukraine held 8 plenary sessions and 5 sessions of the Grand Chamber, 2 sessions of the Constitutional Court of Ukraine related to the organisational activities of the Court, as well as 3 plenary sessions of the Second Senate.

4 cases upon 2 constitutional petitions and 4 constitutional complaints were considered at 4 public parts of the plenary sessions of the Grand Chamber of the Court, which took place in the form of written and oral proceedings. Upon their consideration 7 rulings were adopted. The Court examined the materials of three cases in public parts of the plenary sessions and proceeded to the in-camera parts for decision. One case upon constitutional complaints will be considered in the public part of the plenary session in the form of oral proceedings.

The Grand Chamber in 4 in-camera parts of plenary sessions continued consideration of 4 cases upon 7 constitutional petitions. Based on the results of consideration of one of the cases, a ruling to terminate the constitutional proceedings was adopted.

During May, 5 sessions of the Grand Chamber took place, at which 13 rulings were adopted to extend the term of rulings of the Constitutional Court of Ukraine on initiating or refusing to initiate constitutional proceedings (upon 11 constitutional complaints, 1 constitutional petition and 1 constitutional appeal). The issue of initiating constitutional proceedings in the case upon a constitutional petition was also considered, the consideration of which will be continued at one of the next sessions of the Grand Chamber.

The Second Senate of the Constitutional Court of Ukraine held 3 plenary sessions at which the consideration of 2 cases upon constitutional complaints in in-camera parts of plenary sessions was continued, as well as the case upon a constitutional complaint in the public part of the plenary session in the form of written proceedings.

In addition, 6 sessions of the Boards of Judges of the First and Second Senates of the Constitutional Court of Ukraine were held, at which 9 rulings were issued refusing to initiate constitutional proceedings in cases upon constitutional complaints (final). Consideration of the issue of initiating constitutional proceedings in the case upon the constitutional petition goes on.

During this period, 34 constitutional complaints were filed in the Constitutional Court of Ukraine. According to the results of the preliminary examination, 14 constitutional complaints were distributed among the judges-rapporteurs. 16 complaints that did not comply with the requirements of the Law of Ukraine "On the Constitutional Court of Ukraine" were returned to the subjects of the right to constitutional complaint. Currently, 4 constitutional complaints are being processed by the Secretariat of the Court.

The Court also received 30 requests for public information and 57 requests from citizens, of which the Secretariat has already processed and provided 58 responses.
