First Senate considered case upon constitutional complaint of Roman Karpenko

On  March 20, 2024, at the public part of the plenary session in the form of written proceedings, the First Senate considered the case upon the constitutional complaint of Roman Karpenko regarding the constitutionality of paragraph 1.17 of Section I of the Law of Ukraine “On Amendments to Certain Legislative Acts of Ukraine on Optimisation of Labour Relations” No. 2352-IX dated July 1,  2022 in relation to Article 119.3 of the Labour Code of Ukraine. The judge-rapporteur in this case is Viktor Kychun.

During the plenary session, the Permanent Representative of the Verkhovna Rada of Ukraine in the Constitutional Court of Ukraine Maksym Dyrdin filed a petition to change the form of constitutional proceedings from written to oral and to involve other participants in the constitutional proceedings, in particular, representatives of the Verkhovna Rada Committee on Social Policy and Protection of Veterans' Rights, the Federation of Employers of Ukraine and a number of ministries of Ukraine.

Following the discussion, the First Senate refused to consider this case at the discretion of the Grand Chamber of the Court. Accordingly, the judges will consider the petitions at one of the sessions of the Grand Chamber of the Court.
