The Constitutional Court will hold whether the Verkhovna Rada of Ukraine acted in the manner required by the Constitution of Ukraine regulating the territorial structure of Ukraine by adopting a resolution rather than a law

On April 25, 2024, at the public part of the plenary session, the Grand Chamber considered in the form of oral proceedings the separate issue: “whether the Verkhovna Rada of Ukraine acted in the manner required by the Constitution of Ukraine regulating the territorial structure of Ukraine by adopting a resolution rather than a law” in the case upon the constitutional petition of 49 People's Deputies of Ukraine regarding the compliance of the Resolution of the Verkhovna Rada of Ukraine “On the Formation and Liquidation of Districts” No. 807-IX dated  July 17, 2020 with the Constitution of Ukraine.

The chairperson of the plenary session, Serhiy Holovaty, underscored that during the deliberation of the case, the Grand Chamber held to deliberate the separate issue in the form of oral proceedings, namely: “whether the Verkhovna Rada of Ukraine acted in the manner required by the Constitution of Ukraine regulating the territorial structure of Ukraine by adopting a resolution rather than a law”.

The judge-rapporteur in the case, Viktor Kolisnyk, advised that the respective case was deliberated in the form of written proceedings on April 20, 2023, in which the Court examined the materials of this constitutional proceedings. However, after that, the representative of the subject of the right to constitutional petition, People's Deputy Serhii Vlasenko, filed a petition with the Constitutional Court of Ukraine to deliberate the separate issue in this case in the form of oral proceedings.

At today's public part of the plenary session, the participant in the constitutional proceedings – the representative of the subject of the right to constitutional petition, People's Deputy Serhii Vlasenko and the involved participant in the constitutional proceedings – the representative of the All-Ukrainian Association of Local Self-Government Bodies “Association of Cities of Ukraine”, Executive Director of the Association Oleksandr Slobozhan presented their positions on the separate issue in this case. They answered the judges’ questions. In conclusion, the Court heard a closing statement by Serhii Vlasenko.

After examining the case files in the public part of the plenary session, the Court proceeded to the in-camera part for a decision.
