Working Group on the Methodology for monitoring the implementation of acts of the Constitutional Court of Ukraine

On August 28–29, 2024, the Working Group with the participation of the Secretariat of the Constitutional Court of Ukraine and Patronage Office of the Judges of the Constitutional Court of Ukraine, and representatives of the Council of Europe discussed practical aspects of the application of the Methodology for monitoring the implementation of acts of the Constitutional Court of Ukraine.

The event was organised within the framework of the Joint Project of the Council of Europe and the Constitutional Court of Ukraine “Support to development of the constitutional justice in Ukraine”, implemented within the European Union and Council of Europe Joint Programme “Partnership for Good Governance”, Phase III. The session was moderated by the Project Manager Siuzanna Mnatsakanian.

Viktor Beschastnyi, Head of the Secretariat of the Court, welcomed the participants and underscored that the events supported by this Project are a significant contribution to the development of constitutional justice. He stressed that monitoring the implementation of the acts of the Constitutional Court of Ukraine is an important process that provides a mechanism for collecting and processing information on the status of implementation of the acts of the Constitutional Court of Ukraine, as well as summarising the practice of their implementation upon the results of constitutional proceedings. Viktor Beschastnyi underlined that such monitoring raises issues that require a detailed study of the relevant theoretical approaches, consideration of the experience of foreign states, and thematic professional discussions.

During the event, the participants discussed different approaches to monitoring, in particular the experience of the Republic of Latvia, which was presented by Kristaps Tamuzs, Head of the Legal Department of the Constitutional Court of the Republic of Latvia, international consultant of the Council of Europe. Olena Boryslavska, Head of the Constitutional Law Department at the Ivan Franko National University of Lviv, National Consultant of the Council of Europe, Member of the Scientific and Advisory Council of the Constitutional Court of Ukraine, explored the problematic aspects and ways to improve the monitoring of the implementation of acts of the Constitutional Court of Ukraine.

In the course of the discussion of the respective issues, the Court employees expressed the confidence that the recommendations provided by the experts will be applied in practice and would contribute to the improvement of the Court functioning.

Viktor Beschastnyi expressed his gratitude to the attendees for their practical advice and lively discussion, as well as the Council of Europe and the European Union for the opportunity to hold such events.

The Head of the Secretariat underlined that the high level of professional discussions, productive and practically oriented debates undoubtedly have a positive impact on strengthening the institutional capacity of the national body of constitutional jurisdiction, and added that such events contribute to the promotion of our common values: democracy, the rule of law and human rights.
