Visit of the delegation of the Constitutional Court of Ukraine to Poland

The delegation of the Constitutional Court of Ukraine, composed of Chairman of the Constitutional Court of Ukraine Stanislav Shevchuk and Judge of the Constitutional Court of Ukraine Vasyl Lemak, paid an official visit to Warsaw (Republic of Poland).
The purpose of the visit was the participation of the delegation in the meeting of the Presidents of the constitutional courts – members of the Association of Constitutional Justice of the Countries of the Baltic and Black Sea Regions (BBCJ). The topic of meeting was “The role of the Constitutional Court in a modern state”.
The event was organised by the Constitutional Tribunal of the Republic of Poland and was attended by the Presidents and Judges of the constitutional control bodies of the Republic of Poland, the Republic of Moldova, Hungary, Georgia and the Republic of Lithuania, in particular, the President of the Constitutional Tribunal of the Republic of Poland Julia Przyłębska, the President of the Constitutional Court of the Republic of Moldova Mihai Poalelungi, the President of the Constitutional Court of Hungary Tamás Sulyok, the President of the Constitutional Court of Georgia Zaza Tavadze, the President of the Constitutional Court of the Republic of Lithuania, Dainius Žalimas.
The event was also attended by the Prime Minister of the Republic of Poland Mateusz Morawiecki, Marshal of the Sejm Marek Tadeusz Kuchciński and the Marshal of the Senate Stanisław Karczewski, Ambassador Extraordinary and Plenipotentiary of Ukraine to the Republic of Poland Andrii Deshchytsia, representatives of academic circles, politicians and mass media. The event was moderated by a well-known journalist Bronisław Wildstein.
The Prime Minister of the Republic of Poland Mateusz Morawiecki noted that the Constitutional Tribunal of the Republic of Poland has had centuries-long constitutional traditions. “In a democratic society, the constitutional system cannot be violated and the constitutional control body plays a key role in such society”, he added. The speaker stressed the importance of respect for the constitutional jurisdiction body and its acts as the highest instance. In his view, despite the fact that decisions of the Constitutional Tribunal of the Republic of Poland sometimes contradict the will of the Government, politicians must respect the supremacy of the Constitution and understand the extremely important role of the constitutional control body. “The higher the trust of the Polish people in the Constitutional Tribunal, the more this body reflects the will of the society”, emphasised the Prime Minister.
In her speech, the President of the Constitutional Tribunal of the Republic of Poland Julia Przyłębska appealed for respect of the Fundamental Law of the State. “Constitution is an expression of the independence of people, which consists of language, culture, traditions and refers to its origin”.
“During debates on the law formation, politicians cannot forget about the basic values – individual, society, state and nation”, she emphasised. President Julia Przyłębska noted that the constitutional courts have the function of controlling compliance with the Constitution. “People have entrusted us with function of controlling observance of the Constitution and we have to carry it out in full”, mentioned President of the Constitutional Tribunal of the Republic of Poland. She stressed that judges of constitutional courts needed keep a cool head and exercise their powers in accordance with the Constitution.
In the frame of the programme of the visit, the Chairman of the Constitutional Court of Ukraine Stanislav Shevchuk and Judge of the Constitutional Court of Ukraine, Vasyl Lemak, together with the President of the Constitutional Tribunal of the Republic of Poland Julia Przyłębska took part in the official ceremony of inauguration of the academic year at the Cardinal Stefan Wyszynski University and laid flowers to the monument of victims of the Smolensk tragedy in 2010.
