On Wednesday, September 15, the Second Senate of the Constitutional Court of Ukraine at the in-camera part of the plenary session continued consideration of the case upon constitutional complaints of Dmytro Krupko on compliance of the provisions of Article 81.1, Article 82.1 of the Criminal Code of Ukraine with the Constitution of Ukraine (constitutionality), Volodymyr Kostin, Oleksandr Melnychenko on constitutionality of provisions of Article 82.1 of the Criminal Code and upon the constitutional complaint of Viktor Gogin on the compliance of Article 81.1 of the Criminal Code of Ukraine with the Constitution of Ukraine. The Court will proceed with consideration of this case on September 16.

The same day, the Second Senate of the Court considered the issue of initiating constitutional proceedings in the case upon the constitutional complaint of Viktor Tatkov on the constitutionality of the provisions of Article 424.4 of the Code of Criminal Procedure of Ukraine. Based on the results of consideration, a Ruling on the refusal to initiate constitutional proceedings in this case was adopted.

Consideration of the issue of initiating constitutional proceedings in the case upon the constitutional complaint of a citizen of Ukraine IhorHGubko on the compliance  of the provision of paragraph 1 of Article 361.5 of the Code of Administrative Procedure of Ukraine with the Constitution of Ukraine (constitutionality) will take place at one of the further sessions of the Second Senate.

The Second Senate also considered the issue of temporary involvement of a judge to the composition of the Second Board of Judges of the Second Senate of the Constitutional Court of Ukraine, which is incompetent due to its composition, from another Board of Judges of the same Senate in order to consider the issue of initiating constitutional proceedings in the case upon the constitutional petition of 49 People's Deputies of Ukraine on the constitutionality of the Decrees of the President of Ukraine "On Removal from Office of the Judge of the Constitutional Court of Ukraine" of December 29, 2020 № 607/2020, "On Removal from Office of the Judge of the Constitutional Court of Ukraine" of February 26, 2021 № 79/2021, "On Some Issues of Ensuring the National Security of Ukraine" of March 27, 2021 № 124/2021. The Second Senate ruled to refer the consideration of the to the Grand Chamber of the Court.

In addition, the First Board of Judges of the First Senate and the First Board of Judges of the Second Senate held their sessions.

Based on the results of consideration of the issue of initiating constitutional proceedings in the case upon the constitutional complaint of Serhiy Trutniev, a Ruling on initiating constitutional proceedings in the part concerning the compliance of the provisions of Article 142.1 of the Code of Ukraine on Administrative Offenses with the Constitution of Ukraine was adopted, and in the other part - the initiating of constitutional proceedings in the case was unanimously refused.

The Ruling (final) of the Board of Judges on the refusal to initiate constitutional proceedings in the case upon the constitutional complaint of Hanna Ihnatenko was also adopted.

The Board of Judges will proceed with consideration of the issue of initiating constitutional proceedings in the case upon the constitutional complaint of Ivan Nikolayenko at its next session.
