Today, 11 December 2025, the First Senate of the Constitutional Court of Ukraine deliberated the case upon the constitutional complaints of Vitalii Hasiak, Serhii Dyniak, and Vitalii Maklashevskyi regarding the constitutionality of Articles 143.1, 132¹.2, 258.8, and 279⁵.4 of the Code of Ukraine on Administrative Offences (hereinafter, the “Code”).
Following its deliberation, the Court delivered Decision No. 7-r(I)/2025, by which it declared Articles 143.1 and Article 132¹.2 of the Code of Ukraine on Administrative Offences constitutional.
Pursuant to Article 143.1 of the Code, administrative liability for offences in the field of road transport safety, including those provided for in Articles 132¹.2 and 132¹.3 of the Code, recorded in automatic mode, shall be borne by the responsible person – an individual in whose name the vehicle is registered. If information about the proper user of the respective vehicle has been entered in the Unified State Register of Vehicles, such proper user shall bear liability. If the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Associations does not contain information on the head of the legal entity in whose name the vehicle is registered as of the time of request, liability shall be borne by the person performing the duties of the head of that legal entity.
Under Article 132¹.2 of the Code, exceeding the weight and dimension limits established by law while operating oversized or overweight vehicles on motor roads, streets, or railway crossings entails the imposition of a fine <…>.
The Court dismissed the constitutional proceedings in the part concerning the constitutionality of Articles 258.8 and 279⁵.4 of the Code due to the submission of the constitutional complaint by an improper subject.
