Participation of the Chairman of the Constitutional Court of Ukraine Yurii Baulin and the judge of the Constitutional Court of Ukraine Stanislav Shevchuk in the official ceremony on the occasion of the 23rd anniversary of the Constitution of the Republic of Lithuania

 

 

 

On October 25-27, 2015 Chairman of the Constitutional Court of Ukraine Yurii Baulin and Judge of the Constitutional Court of Ukraine Stanislav Shevchuk took part in the official ceremony dedicated to the 23rd anniversary of the Constitution of the Republic of Lithuania.

On October 26, 2015 the Ukrainian delegation visited the Seimas of the Republic of Lithuania, where an official meeting of the heads of constitutional courts with H.E Speaker of the Seimas of theRepublic of Lithuania Ms. Loreta Graužinienė was held. The event was also attended by the President of the Constitutional Court of Georgia George Papuashvili, President of the Constitutional Court of theRepublic of Latvia Aldis Laviņš, President of the Constitutional Court of the Republic of MoldovaAlexandru Tănase, President of the Constitutional Court of the Republic of Lithuania Dainius Žalimas.

During the meeting the Speaker of the Seimas of the Republic of Lithuania stressed on the importance of close and constructive dialogue and cooperation between the Constitutional Court of the Republic of Lithuania and the Constitutional Courts of Ukraine, Moldova and Georgia. She noted that cooperation in the legal field is a promising and important, since "in the light of geopolitical issues it is necessary for the strengthening of the activity of the constitutional courts in all countries of the Eastern Partnership".

In turn, the President of the Constitutional Court of the Republic of Lithuania DainiusŽalimas noted that "legal community seeks to actively promote the democratisation of Eastern Partnership countries and their Euro-Atlantic integration, the successful implementation of constitutional reforms and strengthening the rule of law and respect for human rights and freedoms".

On the same day Yurii Baulin and Stanislav Shevchuk visited the Constitutional Court of the Republic of Lithuania, where the round table on "The Dialogue between the Constitutional Courts: Preconditions, Platforms, Perspectives" was held and where the participants discussed the perspectives for expanding mutual international cooperation in the field of constitutional justice.

On October 26, 2015 Chairman of the Constitutional Court of Ukraine Yurii Baulin, President of the Constitutional Court of Georgia George Papuashvili, President of the Constitutional Court of the Republic of Moldova Alexandru Tănase, and President of the Constitutional Court of the Republic of Lithuania Dainius Žalimas signed the Declaration on the Establishment of the Association of Constitutional Justice of the Countries of the Baltic and Black Sea Regions. By this Declaration they confirmed their intention to strengthen constitutional justice in the countries of the Baltic and Black Sea Regions and agreed to promote dialogue on all issues regarding the constitutional, structural and operational aspects of constitutional jurisdiction.

On October 27, 2015 the official ceremony dedicated to the 23rd anniversary of the Constitution of the Republic of Lithuania took place. The event was attended by H.E President of the Republic of Lithuania Ms. Dalia Grybauskaitė , H.E.Speaker of the Seimas of the Republic of Lithuania Loreta Graužinienė, Prime Minister of the Republic of Lithuania Algirdas Butkevičius, Minister of Justice of the Republic of Lithuania Juozas Bernatonis, President of the Constitutional Court of the Republic of Lithuania Dainius Žalimas, judges of the Constitutional Court of the Republic of Lithuania, foreign ambassadors, academicians, representatives of the judiciary, legislative and executive authorities, international organisations, representatives of the Constitutional Courts of Georgia, the Republic of Latvia, the Republic of Moldova, Ukraine and the Constitutional Tribunal of the Republic of Poland.

Welcoming the audience, President of the Constitutional Court of the Republic of LithuaniaDainius Žalimas pointed out that the Constitution of the Republic of Lithuania, adopted on October 25, 1992 in a referendum by the Lithuanian nation has been the longest and most stable in its history. "The stability of the Constitution is important because only being stable, it can be a strong foundation for society and the state", said the spokesman.

President of the Republic of Lithuania Dalia Grybauskaitė noted in her speech that the Constitution guarantees the stability and security of the state and the rights of everyone. "We have to make sure that neither the word nor the weapon will encroach on the fundamental values – independence, territorial integrity and constitutional order," said the President.

Speaker of the Seimas of the Republic of Lithuania Loreta Graužinienė dwelt upon the need for every citizen to know his/her rights and freedoms protected by the Constitution of the Republicof Lithuania.

Prime Minister of the Republic of Lithuania Algirdas Butkevičius in his speech stressed that only a deep knowledge of the Constitution allows us to have a better understanding of the constitutional foundations on which our state is built.

In their words of greeting, foreign guests highlighted successful and fruitful cooperation between the constitutional courts, the need to learn from each other and thus, enrich their experience to ensure the effective operation of constitutional courts.

Chairman of the Constitutional Court of Ukraine Yurii Baulin also congratulated the participants "on one of the main national holidays of the Republic of Lithuania – Constitution Day" and expressed his gratitude for the invitation to take part in celebrations on the occasion of this remarkable event in the life of friendly Lithuanian people.

"Without exaggeration, the adoption of the Constitution of the Republic of Lithuania upon the results of the referendum, held on October 25,1992, became the main event in the development of modern Lithuanian statehood, started in already distant 90s of the last century", said Yurii Baulin.

Chairman of the Constitutional Court pointed out that the principles of constitutionalism, which have become a basic principle of settlement of legal relations in modern Lithuania, had been formed not only by experience of the European democracy, but have got deep historical roots. "It is worth mentioning that folded at that time the Casimir's Code of Grand Duke of Lithuania and the Statutes of the Grand Duchy of Lithuania far outstripped the legal acts of that time of the states of European continent by the level of the their legal culture and legal determination",continued Yu.Baulin.

Concluding the report, the Chairman of the Constitutional Court of Ukraine expressed his sincere gratitude to the friendly people of Lithuania for support of Ukraine in its difficult times.

Professor Hanna Suchocka presented report on the topic "The new constitutions and the process of amending the constitution in Central and Eastern Europe - "post-transformation" effect?". She noted that despite the common goal - a departure of the countries that had experienced a transformation in 1990 from communism, had significant differences among themselves. "One of the major differences is conditioned by different "experience" of statehood and constitutionalism", continued the reporter.

"From the beginning of the transformation period in different countries there were concerns about the "unification" of legal norms and excessive "standardisation" of the decisions of a constitutional nature. It particularly refers to some individual rights and freedoms", said the professor.

In her report, Hanna Suchocka stressed that some constitutional changes resulted from the political and security arrangements. "This trend entails constitutional changes carried out in such a way and in such a form, leading to fears of using the Constitution as a tool", continued the reporter.

In conclusion, Professor Hanna Suchocka stressed that the element of permanence of the constitution can not be based solely on arithmetic reasoning in connection with correspondence of numerical expression of the benefits of the ruling elites in parliamentand parties that are in opposition. "And the way (procedure) of the adoption and application of the Constitution should create changes in society influenced by political circumstances. Otherwise, a situation may arise in which, according to the words of one member of the Polish constitutional debate, "politics devour the Constitution", said the speaker.

A former justice of the Constitutional Court of the Republic of Lithuania, Professor Vytautas Sinkevičius also made a presentation. He noted that since the adoption of the Constitution of the Republic of Lithuania, the concept of the Constitution (and the legal system itself) had changed significantly. "From the concept of the Constitution as the Basic law we passed to the concept of the Constitution as a special legal act that is above the laws, and is the supreme national law, which consists not only of norms, but of principles as well and contains not only explicit, but implicit legal regulation ", added the spokesman.

Vytautas Sinkevičius stressed that the Constitution is increasingly perceived as a complex legal reality, as well as harmonious legal system of law in which all the legal provisions are harmonised among themselves, in which there are no legal gaps and internal contradictions.

The professor pointed out that being exposed to constant interpretation, the Constitution is constantly developing law. "Thus, in time the Constitution is not only preserved but protected from the threat of the past time because the permanent interpretation of its provisions gives them appreciable essence and existence," said Mr. Sinkevičius.

Concluding his report, the spokesman stressed that "no matter how the content of the Constitution is changed by amendments, no matter how many aspects of its content is revealed by interpretation, true Constitution is not on paper but it is in how we really respect and implement it into life."

During the visit to the Constitutional Court of the Republic of Lithuania Chairman of the Constitutional Court of Ukraine Yurii Baulin made an entry to the Book of honoured guests.

During the visit to the Republic of Lithuania the Chairman of the Constitutional Court of Ukraine also gave an interview to BNS news agency, in which the constitutional reform in Ukraine and the initiative of the Constitutional Court of Ukraine in Batumi in September this year, that resulted in a Joint Statement were discussed.
