Oleksandr Tupytskyi: ‘The legal community of Ukraine must unite to create a law-based state that will effectively protect human and citizen’s rights and freedoms”
On May 29, the Chairman of the Constitutional Court of Ukraine Oleksandr Tupytskyi took part in a video conference format in the final day of the III Judicial Forum.
The three-day event, which brought together judges, lawyers, government officials, academics and prominent lawyers, included a discussion of the current state and prospects of Ukraine’s judiciary. The participants of the online forum considered a number of important and topical issues, including judicial reform, procedural novelties, access to justice, reform of the Grand Chamber of the Supreme Court, the High Council of Justice, the High Qualification Commission of Judges of Ukraine, the practice of resolving by courts the issues that arise while enforcement proceedings.
Within the first session "Judicial reform. Vol. 2.0.2.0" The Chairman of the Constitutional Court of Ukraine Oleksandr Tupytskyi presented a report on the place of the Constitutional Court of Ukraine in the judicial system.
In particular, he noted that after the constitutional reform of 2016, the Constitutional Court of Ukraine was separated from the judicial power, so further reform of the Court may take into account the existing legislative changes. At the same time, the Chairman of the Constitutional Court of Ukraine stressed that the activities of the body of constitutional jurisdiction are aimed at ensuring the stability and inviolability of the constitutional order, as well as the protection of the constitutional rights of citizens.
In this context, Oleksandr Tupytskyi focused on the institute of the constitutional complaint, which had been introduced into the legal system of Ukraine in September 2016. He emphasised that during this period, about 2,000 applicants filed complaints with the Court. According to the Chairman of the Court, a constitutional complaint is an extremely important tool for the protection of human rights, so in order to effectively implement it, it is necessary to regulate a number of issues in this area at the legislative level.
In his speech, Oleksandr Tupytskyi also stressed the existing problem of implementation of acts of the Constitutional Court of Ukraine, which according to the Basic Law of Ukraine are binding, final and may not be appealed.

During the session, speeches were also delivered by the Head of the Verkhovna Rada Committee on Legal Policy Andrii Kostin, the Rector of the National School of Judges of Ukraine Mykola Onishchuk, Acting Chairman of the Supreme Court Vasyl Humeniuk, Minister of Justice of Ukraine Denys Maliuska, Deputy Chairman of the High Council of Justice, Member of the First Disciplinary Chamber Oleksii Malovatskyi, Secretary of the Grand Chamber of the Supreme Court Vsevolod Kniazev and VB PARTNERS partner Volodymyr Vashchenko.
The Constitutional Court of Ukraine was also represented at the event by the Head of the Secretariat Viktor Beschastnyi.
