October 6. The Court’s Agenda (Approved). Sessions of the First Senate, Plenary Session of the Second Senate and Sessions of the Boards of Judges Were Held

On Wednesday, October 6, the First Senate of the Court considered the issue of recusal of the Judge of the Court of the Constitutional Court of Ukraine V. Kryvenko in the cases upon the constitutional complaint of Ye. Bulka regarding the compliance of the provisions of Article 2.1 of the Law of Ukraine “On  Measures on Legislative Provision of Pension System Reforms” of July 8, 2011 No. 3668-VI with the Constitution of Ukraine and upon the constitutional complaint of H.Raikun  regarding the constitutionality of the provisions of Articles 2 of the Law of Ukraine “On  Measures on Legislative Provision of Pension System Reforms” of July 8, 2011 No. 3668-VI, Article 86.15.6.1 of the Law of Ukraine “On the Prosecutor's Office” of October 14, 2014 No. 1697- VII. Upon the results of the deliberation, 2 rulings of the First Senate to refuse to satisfy the recusal in these cases were adopted.

On this day, the Second Senate of the Court in the in-camera part of the plenary session considered the case upon the constitutional complaint of Private Joint Stock Company “Chernihivoblbud” on compliance of the provision of  subparagraph "b"  of Article 14.3.1 of the Law of Ukraine “On Ensuring the Realisation of Housing Rights of Dormitory Residents” with the Constitution of Ukraine. Deliberation of cases will be proceeded at one of the next plenary sessions.

In addition, at the sessions of the First Chamber of Judges of the First Senate and the Second Chambers of Judges of the Second Senate of the Court, initiation of constitutional proceedings was considered in the following cases:

upon the constitutional complaint of V. Bala regarding the compliance of the provisions of Article 59.3 of the Law of Ukraine “On Status And Social Protection of Citizens Affected by the Chernobyl Disaster”, Articles 11, and 21 of the Law of Ukraine “On Pension Provision to Persons Discharged from Military Service and for Some Other Persons”;

• upon the constitutional complaint of N.Lebedyk concerning the compliance of the provisions of paragraph of Article 388.1.3 of the Civil Code of Ukraine with the Constitution of Ukraine;

• upon the constitutional complaint of V.Aleksenko regarding the compliance of the provisions of Article 59.3 of the Law of Ukraine “On Status And Social Protection of Citizens Affected by the Chernobyl Disaster”, Articles 11, and 21 of the Law of Ukraine “On Pension Provision to Persons Discharged from Military Service and for Some Other Persons”;

• upon the constitutional complaint of O.Benedychuk regarding the compliance of the provisions of Article 5.1 and Article 459.1 of the Criminal Procedure Code of Ukraine with the Constitution of Ukraine;

• upon the constitutional complaint of N.Hlukhovtseva regarding the compliance of the provisions of Article 279³.1 of the Code of Ukraine on Administrative Offenses with the Constitution of Ukraine;

• upon the constitutional complaint of O.Volter regarding the compliance of certain provisions of Articles 152 and 198 of the Land Code of Ukraine with the Constitutions of Ukraine.

6 rulings on refusal to initiate constitutional proceedings in these cases (final) were adopted.
