October 20. The Court Agenda (approved). Sessions of the First and Second Senates of the Court: deliberation of cases upon constitutional complaints. Decision upon the constitutional complaint of PJSC “Chernihivoblbud” delivered

On Wednesday, October 20, the First Senate in public parts of plenary sessions in the form of written proceedings considered 3 cases:

- upon the constitutional complaint of Roman Truba regarding the compliance of the provisions of Article 11.1.2 of the Law of Ukraine “On the State Bureau of Investigations” and clauses 1 and 2 of subparagraphs 2 of paragraph 3 of Section II “Final and transitional provisions” of the Law of Ukraine “On Amendments to Certain Laws of Ukraine on Improving the Activities of the State Bureau of Investigations” with the Constitution of Ukraine;

- upon the constitutional complaint of Antonina Bolotnikova regarding the compliance of the provisions of Article 86.15.6 of the Law of Ukraine “On the Prosecutor's Office” of October 14 2014 No. 1697-VII, Article 2 of the Law of Ukraine “On Measures to Ensure the Legislative Reform of the Pension System” of July 8, 2011 No. 3668-VI with the Constitution of Ukraine;

- upon the constitutional complaint of Roman Unukovych regarding the compliance of a specific provision of Article 204³.1.2 of the Code of Ukraine on Administrative Offenses with the Constitution of Ukraine.

The court examined the materials of these cases in public parts of plenary sessions and proceeded to in-camera parts for decision.

The plenary session of the First Senate also deliberated the issue of refusing to consider the case upon the constitutional complaint of Mykola Kostin on the constitutionality of a specific provision of paragraph 26 of Section VI “Final and Transitional Provisions” of the Budget Code of Ukraine at discretion of the Grand Chamber of the Constitutional Court. Deliberation of this issue will be proceeded at one of the next plenary sessions of the First Senate.

Following the results of the discussion on determining the form of constitutional proceedings in the case upon the constitutional complaint of Hanna Raikun on the compliance of the provisions of Article 2 of the Law of Ukraine “On Measures to Ensure the Legislative Reform of the Pension System”, Article 86.15.6.1 of the Law of Ukraine “On the Prosecutor's Office“ with the Constitution of Ukraine the ruling of the First Senate of the Court was adopted. The case will be deliberated in the public part of the plenary session in the form of written proceedings.

On the same day, the Second Senate of the Court at in-camera part of the plenary session proceeded with deliberation of the case upon the constitutional complaint of PJSC “Chernihivoblbud” on compliance of the provisions of subparagraph "b" of paragraph 1 of part three of Article 14 of the Law of Ukraine “On Ensuring Implementation of Housing Rights of Dormitory Residents” with the Constitution of Ukraine. Following the deliberation of this case, Decision No. 7-r (II)/2021 was delivered and will be published on the official website of the CCU on October 21.

The Second Senate at the plenary session proceeded with deliberation of the case upon the constitutional complaint of Oleksii Abramovich regarding the compliance of the provisions of Article 40.2.2 of the Housing Code of the Ukrainian SSR with the Constitution of Ukraine. Its consideration will be further proceeded.

In the case upon the constitutional complaint of a citizen of Ukraine Pavlo Skoda regarding the compliance of the provisions of Article 392.2, Article 428.2.2 of the Criminal Procedure Code of Ukraine with the Constitution of Ukraine, the Second Senate decided to terminate the constitutional proceedings.

In addition, a session of the First Board of Judges of the Second Senate of the Constitutional Court of Ukraine was held, at which the Ruling on initiating constitutional proceedings in the case upon the constitutional complaint of Liudmyla Solomakha on the compliance of the provisions of Article 142.3 of the Law of Ukraine “On Judiciary and Status of Judges” of June 2, 2016 No. 1402-VIII as amended with Constitution of Ukraine, was adopted. The case will be deliberated at a session of the Second Senate of the CCU.
