November 22. The court deliberated cases upon the constitutional complaints and delivered a Decision

Today, November 22, 2023, the First Senate, at the in-camera part of the plenary session, deliberated the case upon the constitutional complaint of Vitalii Hasiak regarding the constitutionality of Article 14-3.1 of the Code of Ukraine on Administrative Offenses. The Court will proceed with its deliberation at one of the next plenary sessions.

The Second Senate at the public part of the plenary session in the form of written proceedings deliberated the case upon the constitutional complaint of Anatolii Bai regarding the constitutionality of Article 176.6 of the Criminal Procedure Code of Ukraine. In this case, the Court proceeded to the in-camera part of the plenary session for a decision.

Moreover, at the in-camera part of the plenary sessions, the Second Senate proceeded with deliberation of cases upon constitutional complaints of:

• Anatolii Luzhynetskyi regarding the constitutionality of certain provisions of Article 111.1 of the Criminal and Executive Code of Ukraine;

• Roman Truba regarding the compliance of the provisions of Article 11.1.2 of the Law of Ukraine “On the State Bureau of Investigations” and clauses 1 and 2 of subparagraphs 2 of paragraph 3 of Section II “Final and transitional provisions” of the Law of Ukraine “On Amendments to Certain Laws of Ukraine on Improving the Activities of the State Bureau of Investigations” with the Constitution of Ukraine.

The Court will proceed with their deliberation at one of the next plenary sessions.

The Second Senate delivered Decision No. 10-r(II)/2023 in the case upon the constitutional complaints of Olha Doroshko, Ivan Kushaba, Mykyta Yevstifeiev, Volodymyr Yakimenko regarding the constitutionality of Articles 19.6.1, 19.6.5, 389.3.2 of the Civil Procedure Code of Ukraine. The Decision will be available on the official website of the Court on November 23.

The Second Senate merged into one constitutional proceeding the cases upon the constitutional complaints of Anatolii Bai and Serhii Bychkov regarding the constitutionality of Article 176.6 of the Criminal Procedure Code of Ukraine.

On the same day, the First Board of Judges of the Second Senate at a session deliberated the issue of initiating constitutional proceedings in the case upon the constitutional complaint of Volodymyr Lopushanskyi regarding the constitutionality of Articles 3.2, 4.2.1.9 of the Law of Ukraine “On Court Fee” and initiated constitutional proceedings in this case. Issues related to the constitutional proceedings in the case will be deliberated at the session of the Second Senate.
