In June the Constitutional Court of Ukraine Held 32 Sessions and Adopted 40 Acts

During June 2021, the Constitutional Court of Ukraine held 32 sessions, including 7 plenary sessions and 8 sessions of the Grand Chamber of the Court, 4 sessions of the Court, 5 plenary sessions of the Second Senate and 2 sessions of the First and Second Senates of the Court, 6 sessions of the Boards of Judges of the Court. Following these sessions, the Court adopted 40 acts.

The Grand Chamber considered 6 cases upon constitutional petitions at the in-camera parts of 6 plenary sessions. Also 8 sessions of the Grand Chamber of the Court were held, at which 23 rulings were adopted to extend the term of adoption of the ruling by the Boards of Judges on the initiating or refusal to initiate constitutional proceedings (upon 23 constitutional complaints, 1 constitutional petition and 1 constitutional appeal), 1 ruling on involvement to participate in the consideration of the case upon constitutional complaints. In addition, the issue of initiating constitutional proceedings in the case upon a constitutional petition was considered, which will be considered at one of the further sessions of the Grand Chamber of the Court.

At the public part of the plenary session of the Grand Chamber of the Court 1 case was considered upon 2 constitutional petitions, following the consideration of the case 1 ruling was adopted.

During the month, 4 sessions of the Court took place, and the Resolution on Approval of the Text of the Annual Information Report of the Constitutional Court of Ukraine for 2020 was adopted.

The Second Senate of the Court at the in-camera parts of 5 plenary sessions proceeded with consideration of 3 cases upon constitutional complaints and adopted 1 ruling. 2 sessions of the First and Second Senates of the Court were also held, at which 2 rulings were adopted, in particular on the form of consideration of the case and temporary involvement of a Judge of the Court to the composition of the Board of Judges which is incompetent due to its composition.

In this period, 6 sessions of the Boards of Judges of the First and Second Senates of the Court were held, at which 10 rulings on refusal to initiate constitutional proceedings upon constitutional complaints (unanimously) and 1 ruling on refusal to initiate constitutional proceedings (not unanimously), the materials of the case file of which were submitted to the Senate, were adopted. In addition, the Board of Judges of the Court at its session proceeds with consideration of the issue of initiating constitutional proceedings in the case upon a constitutional petition.

During this period, 47 constitutional complaints were filed with the Constitutional Court of Ukraine. According to the results of the preliminary review, 24 constitutional complaints were distributed among the Judges-Rapporteurs. 17 constitutional complaints which did not meet the requirements of the Law of Ukraine “On the Constitutional Court of Ukraine” were returned to the subjects of the right to constitutional complaint, and 6 constitutional complaints are being processed by the Secretariat of the Court.

In addition, the Secretariat of the Court prepared and sent 75 responses to inquiries for public information, as well as citizens' appeals.
