Judges of the Second Senate of the Constitutional Court of Ukraine considered a number of cases
upon constitutional complaints

Today, February 17, the Second Senate of the Constitutional Court of Ukraine at a plenary session considered the case upon the constitutional complaint of Ukrainian citizen Oleksandr Diachenko (and other citizens of Ukraine) on compliance of item 4.13 of section I of the Law of Ukraine “On Amendments and Repeal of Certain Legislative Acts of Ukraine” of December 28, 2014 №76-VIII with the Constitution of Ukraine. The Court will proceed with consideration of this case at one of the upcoming plenary sessions.

The Senate also considered the case upon the constitutional complaint of Olena Koshyk regarding the constitutionality of the provisions of Article 48.7 of the Law of Ukraine “On Civil Service” of December 10, 2015 № 889-VIII in conjunction with the provisions of Article 21.1, Article 21.2, Article 46.2.8 of this Law. The Resolution on termination of the constitutional proceedings in this case was adopted.

At the plenary session, the Second Senate of the Court continued consideration of the case and the constitutional complaint of the Public Stock Company ‘Stock Commercial Bank "INDUSTRIALBANK"’ on the compliance of the provisions of Article 13.3, Article 16.3 of the Civil Code of Ukraine with the Constitution of Ukraine. The Court will proceed with consideration of this case at one of the further plenary sessions. The Second Senate of the Court adopted two rulings based on the results of consideration of judges' applications for recusal.

Beside this, a session of the Third Board of Judges of the Second Senate of the Constitutional Court of Ukraine took place in order to consider the issue of initiating the constitutional proceedings in the case upon the constitutional complaint of Vasyl Mesevria on the compliance of the provisions of item 2.2 of Section II "Final and Transitional Provisions" of the Law of Ukraine "On Measures Concerning Legislative Support for Pension System Reform" with the Constitution of Ukraine, as well as the official interpretation of the provisions of Article 53.3 of the Law of Ukraine "On Pension Provision". Based on the results of the session, a Ruling was adopted on refusal to initiate constitutional proceedings in this case.
