Judge of the Constitutional Court of Ukraine Stanislav Shevchuk took part in the meeting of the Federalist Society’s National Lawyers Convention and European Judicial Network Conference

 

On November 12-17, 2015 on the invitation of the Executive Vice-President of the Federalist Society for Law and Public Policy Studies Leonard Leo, judge of the Constitutional Court of Ukraine Stanislav Shevchuk took part in the meeting of the Federalist Society’s National Lawyers Convention and European Judicial Network Conference held in Washington, D.C. (USA).

The program of this year meeting of the Federalist Society’s National Lawyers consisted of three key platforms which included presentations and discussions and official reception of more than 1300 lawyers and judges from the whole America.

During the first platform the questions of federalism and separation of powers, the role and powers of the Congress according to the provisions of the US Constitution, ensuring the balance of national and local interests by the Congress members, interaction of the House of Representatives and the Senate were addressed. On the occasion of the 80-th anniversary of the adoption of the National Labor Relations Act the retrospective analysis of the major problems of labor and employment in the USA was presented.

During the second platform members applied to the problems of the effectiveness of the Congress considering the constant growth of workload, the need to reduce the number of government and reduce the use of administrative resources of the state. Attention was also paid to individual civil rights, criminal and anti-corruption legislation and issues of national security law. Improving financial services and e-commerce were also discussed.

The third platform touched upon the possibilities of shifting the responsibility from the Congress as the legislative branch of power to the executive or judicial. Among other issues attention was also stressed on the role of Congress in the problems of environmental protection, property ownership rights and intellectual property rights.

During November 14-17 a session of the European Judicial Network of the Federalist Society was held in which representatives of the American legal community and judges of the European constitutional courts (Georgia, Lithuania, Moldova, Poland, Slovenia, Hungary, Ukraine), the European Court of Justice and the European Court of Human Rights took part.

In the framework of the session the participants discussed the following topics: 1) Freedom of expression of opinions and media in Central and Eastern Europe; 2) The importance of the role of constitutional courts in determining the limits of freedom of expression and association in the light of hybrid propaganda war; 3) Education of citizens: the possibility of national courts in promoting constitutionalism, rule of law and respect for justice; 4) Right for conscious refuse from health and government administration; 5) The independence of judges after retirement and possibility to continue their career in the judicial system and so on.

Judge of the Constitutional Court of Ukraine Stanislav Shevchuk met with the Ambassador of Ukraine to the USA Valerii Chalyi. The meeting was also attended by the President of the Constitutional Court of the Republic of Lithuania Dainius Žalimas, President of the Constitutional Court of the Republic of Moldova Alexandru Tănase and Director of International Affairs for the Federalist Society for Law and Public Policy Studies James P. Kelly. Ambassador of Ukraine to the USA Valerii Chalyi thanked the Presidents of constitutional courts of the Republic of Lithuania and the Republic of Moldova for their consistent and principle support of our state, in particular for the support given by the members of the Conference of European Constitutional Courts to the initiative of the Constitutional Court of Ukraine to provide the appropriate assessment of the decision of the Constitutional Court of Russian Federation of March 19, 2014, which had been used as the key element in the process of annexation of the Autonomous Republic of Crimea by Russian Federation.

Stanislav Shevchuk took part in the event at the US Supreme Court, hosted by the judge Samuel Alito during which issues of common interest for the European and American judges were discussed.

In addition, judge Shevchuk visited Mount Vernon, the patrimonial estate of George Washington, where on the behalf of Federalist Society he laid a memorial wreath to the grave of the first President of the United States of America.
