Judge of the Constitutional Court of Ukraine Serhiy Holovaty participated in the opening ceremony of the first-in-the-world international certificate program in rule of law

On November 12, Judge of the Constitutional Court of Ukraine Serhiy Holovaty participated in the opening ceremony of international certificate program in rule of law launched for the first time in the world.

The Programme, created by Yaroslav Mudryi National Law University and University of South Carolina (USA) with the support of the USAID New Justice Program, has been designed for judges, prosecutors, attorneys and other practicing lawyers, as well as Master/Postgraduate program students of law schools. The goal of the program is to improve the lawyers’ skills in applying rule of law in their everyday work.

The event was opened by the leader of the working group on developing the Certificate Program in Rule of Law, Vice Rector of the Yaroslav Mudry National University Yurii Barabash. He emphasised that the program is a unique project, a challenge and invaluable experience for the university as a law school. He also noted that each class is taught by both domestic university professor and a tutor from the University of South Carolina, and a representative of the USAID New Justice Program. This discussion will result in exchange of thoughts and formulating certain practical concepts.

​​The USAID New Justice Program Chief David Vaughn mentioned that the Program will help judges, prosecutors, attorneys and other practicing lawyers, students of law schools to develop a common vision, understanding and practical application of the rule of law. Moreover, the high level of interest to this program proves its topicality. “I am happy to congratulate you – 30 winners who will develop common understanding of the rule of law principle and will learn to apply it in practice”, highlighted David Vaughn.

The program started with a lecture of the Judge of the Constitutional Court of Ukraine Serhiy Holovaty, Professor, PhD in Law on the “Rule of Law: Origin, Evolution and Challenges in Understanding”. He referred to the emergence of the term “rule of law” in Ukraine, how it began to be interpreted in the Ukrainian legal science and in which way misunderstanding and interpretation in official doctrine thereof was caused.

Serhiy Holovaty pointed out that a judge, attorney, or prosecutor should find his/her own path to understand the answer that the rule of law provides for the solution of a specific legal issue, to find legal tools to support such notions as human rights, the rule of law, genuine democracy, constitution as fundamental law.
