Upon the invitation of the Ibero-American Institute for Constitutional Law and the Institute of Legal Research of the National Autonomous University of Mexico, Judge of the Constitutional Court of Ukraine Olga Sovgyria participated in the XVI Ibero-American Congress of Constitutional Law “Constitutionalism for the Democracy of the XXI Century” held on October 21–25, in Mexico City (Mexico).
The Congress brought together more than 150 constitutionalists from different countries, including Latin America countries (Argentina, Brazil, Chile, Ecuador, Peru, etc.), as well as from France, Germany, Italy, Poland, Spain, Türkiye, and the USA.
Within the framework of the section “Organisation of Constitutional Justice”, Olga Sovgyria delivered a presentation on “State Governed by the Rule of Law in the Time of War: Challenges to the Constitutional Justice of Ukraine”.
The presentation covers certain positions of the Constitutional Court of Ukraine set out in its decisions delivered before the large-scale invasion, in particular in cases of condemnation of the totalitarian communist and national socialist (Nazi) regimes in Ukraine and prohibition of propaganda of their symbols; prohibition of distribution and demonstration of audio-visual materials of Russian propaganda.
Particular attention is paid to the decisions of the Constitutional Court of Ukraine delivered after February 24, 2022: both those related to improving social protection of military servicemen and servicewomen as well as social guarantees for defenders of Ukraine, and other issues related to the protection of sovereignty and territorial integrity of Ukraine.
The presentation also addresses the issue of postponement of the cessation to be effective of the norms declared unconstitutional due to the introduction of martial law in Ukraine.
