Judge of the Constitutional Court of Ukraine Natalia Shaptala took part in the International Scientific and Practical Conference
On the occasion of the 20th anniversary of the Constitution of the Republic of Kazakhstan, judge of the Constitutional Court of Ukraine Natalia Shaptala took part in the international scientific and practical conference "The Constitution: Unity, Stability, Prosperity", held on August 28-29, 2015 in Astana in the Palace of Independence, L.N.Gumilev Eurasian National University and Kazakh University of Humanities and Law.
The conference was attended by the President of the Republic of Kazakhstan N.Nazarbayev, heads of both chambers of the supreme legislative body of the state, Prime Minister of the Republic of Kazakhstan, delegations of the authoritative internationalorganisations: UN, Venice Commission of the Council of Europe, OSCE, European Union, European Court of Human Rights etc., and foreign delegations of the bodies of constitutional jurisdiction, the highest judicial institutions and academic circles from 28 countries, including Azerbaijan, Belarus, Benin, Bulgaria, Armenia, Georgia, Egypt, Indonesia, Jordan, Kyrgyzstan, Korea, Latvia, Malaysia, Moldova, Mongolia, Macedonia, Germany, UAE, Russia, Romania, Serbia, Tajikistan, Turkey, Uzbekistan, France, Croatia, representatives of ministries and agencies, human rights organisations, political parties, scientific and educational institutions of the Republic of Kazakhstan.
President of the Republic of Kazakhstan – Leader of the Nation N. Nazarbayev and Chairman of the Constitutional Council of the Republicof Kazakhstan I. Rogov addressed the participants of the conference with opening speeches.
During the working sessions, participants discussed a number of issues related directly to the Fundamental Law of the Republic of Kazakhstan, its history, development, functioning, as well as the development and functioning of constitutional institutions in the countries participating in the forum.
Judge of the Constitutional Court of Ukraine Natalia Shaptala presented a report on "Inviolability of fundamental constitutional principles as the basis of stability of the legal status of an individual in the legal state".
On behalf of the Chairman, judges of the Constitutional Court of Ukraine and herself Natalia Shaptalacongratulated citizens of the Republic of Kazakhstan on the 20th anniversary of the Constitution of the country and wished them peace, welfare and prosperity, and emphasised that the experience gained during the international conference is invaluable, and wished the participants unity in the developing the constitutional principles of the fundamentals of statehood in the name of welfare of our nations, their development and prosperity.
In her speech, the judge mentioned that the Constitution of Ukraine adopted in 1996 was assessed by the international community as one of the most advanced Basic Laws in Europe. But the work for improvement of the current constitutional regulation has been ongoing for 19 years.
However, Natalia Shaptala stressed that the inviolability of fundamental constitutional principles and regulations as well as relevant legal positions of the Constitutional Court of Ukraine, their implementation into daily life are the main guarantee of stability in the country, in particular the guarantee of the legal status of an individual in the country. The practice of the constitutional courts shows that when considering cases challenging possible restriction of human rights and freedoms, in conditions of economic instability of a state or economic crisis, their temporary restriction is possible. The purpose of such restriction is to ensure proper functioning of both specific institutions of the state and the state as a whole.
Awarding the representatives of foreign delegations of constitutional courts, well-known public figures and scholars on the occasion of the 20th anniversary of the Constitution of the Republic of Kazakhstan with the jubilee and commemorative medals of the President of the Republic of Kazakhstan became a significant moment in the international conference. In particular, the Ukrainian constitutionalists – Chairman of the Constitutional Court ofUkraine Yurii Baulin and judge of the Constitutional Court of Ukraine Natalia Shaptala – were awarded therewith.
In addition, Natalia Shaptala gave an interview to the republican newspaper "KazakhstanskayaPravda", in which she congratulated the people of the Republic of Kazakhstan on the great holiday – the 20th anniversary of the Constitution. In her greeting, the judge that the Fundamental Law of the Republic of Kazakhstan reflects the most important constitutional principles, the implementation of which is aimed at the human benefit, the protection of the rights and freedoms, comprehensive development and improvement of the state and legal structure, and noted that Ukraine traditionally supports friendly relations with Kazakhstan.
According to the program, the participants of the conference visited the Library of the First President of the Republic of Kazakhstan – Leader of the Nation N. Nazarbayev, which was established by the Decree of the President of the Republic of Kazakhstan to ensure the functioning of the personal library and personal archive of the President, to study the history of formation and development of the Republic of Kazakhstan as well as promotion of the ideas and initiatives of the President in the country and abroad. The Library’s funds comprise over 40,000 books and 700 items from the personal collection of N. Nazarbayev.
The conference delegates visited the youngest and largest museum of Central Asia – the National Museum of the Republic of Kazakhstan, Nazarbayev University, the grand twenty-meters architectural building - Arc de Triomphe, which was opened on the occasion of the 20th anniversary of Independence of the Republic of Kazakhstan and the exhibition of the People's Assembly of Kazakhstan, held in the Palace of Peace and Reconciliation, and together with the Presidents of the Republic of Kazakhstan and the Republic of Serbia attended the festive concert dedicated to the 20th anniversary of the Constitution of the Republic of Kazakhstan. In addition, judge of the Constitutional Court of Ukraine Natalia Shaptala met with the representatives of the Ukrainian diaspora inKazakhstan.
