Information on Consideration of Cases by the Constitutional Court of Ukraine

On 3 March 2021, plenary sessions and sessions of the First and Second Senates were held at the Constitutional Court of Ukraine.

The First Senate, upon the results of consideration of the case upon the constitutional complaint of Taras Zayats on constitutionality of the  provisions of Article 88.3 of the Law of Ukraine “On the Judiciary and the Status of Judges“ of 2 June 2016 No.1402-VІІІ made a Ruling on relinquishment of the case in favour of the Grand Chamber.

The Second Senate considered the case upon the constitutional complaint of Public Joint-Stock Company Joint-Stock Commercial Bank “Industrialbank” on the constitutionality of the provisions of Articles 13.3 and 16.3 of the Civil Code of Ukraine. The Senate will continue the examination of the case at one of the next plenary sessions.

The Second Senate also considered the issue on initiating the constitutional proceedings in the case upon the constitutional complaint of Serhii Polischuk on the constitutionality of clause 4 of Article 16-3 of the Law of Ukraine "On Social and Legal Protection of Military Servicemen and Members of their Families" and will continue its examination at one of its following sessions.

During the hearing of the Third Board of Judges of the Second Senate, two rulings (not unanimous) on refusal to initiate the constitutional proceedings  were made: in the case upon the constitutional complaint of Oleksandr Krotiuk on compliance of the provision of clause 4 of Article 284.1 of the Code of Criminal Procedure of Ukraine with the Constitution of Ukraine and in the case upon the constitutional complaint of Viktor Kotenko on compliance of the provision of clause 2 of Articles 424.2 and 424.3 of the Code of Civil Procedure of Ukraine with the Constitution of Ukraine.

Hence, the issue on initiating the constitutional proceedings in the above cases will be examined during the hearings of the Second Senate of the Constitutional Court of Ukraine.
