Head of the Standing Commission on international relations of the Constitutional Court of Ukraine Stanislav Shevchuk met with a senior legal expert of the IMF evaluation mission Sebastiaan Pompe
On July 2, 2014 upon the request of the IMF Office in Ukraine Judge of the Constitutional Court of Ukraine, Head of the Standing Commission on international relations of the Constitutional Court of UkraineStanislav Shevchuk met with a senior legal expert of the IMF evaluation mission Sebastiaan Pompe. The dialogue was held in the framework of the IMF mission which activity is aimed at studying the state of implementation by the Ukrainian government of the financial program “Stand-By”, which provides anti-corruption measures and reforms of the judiciary in Ukraine.
Sebastiaan Pompe informed that IMF conducts a comprehensive analysis of the commitments in the spheres of governance, judiciary and anti-corruption, assumed by Ukraine according to the Memorandum of economic and financial policies in the framework of the financial program “Stand-By”. Based on the collected information, the IMF evaluation mission is to prepare a report assessing the economic situation in Ukraineand existing risks for further implementation of the agreement. To that end, during May - June the IMF experts visited the higher courts, state bodies and government structures where they got acquainted with the information concerning the activities of the judicial system and its reforming, anti-corruption measures, money laundering and improvement of the business climate in Ukraine.
Taking into consideration the spectrum of issues that are of interest for the mission, judge StanislavShevchuk provided his interlocutor with an extensive information about the tasks and authorities of the Constitutional Court of Ukraine on the review of the constitutional petitions and constitutional appeals, principles of formation of the Court’s composition, functions of the Secretariat of the Court, statistics regarding cases examined by the Court etc. In addition, the judge dwelt upon the decisions of the Constitutional Court of Ukraine in the context of the foreign policy situation, in particular, he informed about the fact and legal grounds of the unilateral termination by the Constitutional Court of Ukraine of the Memorandum on co-operation with the Constitutional Court of Russian Federation with regard to the annexation of Crimea by Russian Federation.
Stanislav Shevchuk also mentioned that the Verkhovna Rada of Ukraine is to consider amendments to the Constitution of Ukraine and, in particular, those concerning decentralisation of power, introduced by the President of Ukraine Petro Poroshenko. As the judge noted, the legislative procedure stipulates mandatory opinion of the Constitutional Court of Ukraine on the conformity of the draft law to the Constitution of Ukraine.
Apart from that, interlocutors discussed the IMF policy in the sphere of judiciary, preventing of the political influence on the judicial power, organisation of the judicial proceedings of specific categories of cases in Ukraine and abroad etc.
In conclusion, Sebastiaan Pompe thanked Stanislav Shevchuk for the substantive dialogue and expressed his interest in continuing such contacts.
