The Grand Chamber of the Constitutional Court of Ukraine Considered Cases upon the Constitutional Petitions
of People's Deputies of Ukraine

 

On Thursday, March 18, during the in-camera parts of the plenary sessions the Grand Chamber of the Constitutional Court of Ukraine proceeded with consideration of cases upon constitutional petitions of:

• 47 People's Deputies of Ukraine regarding the constitutionality of the provisions of Article 6.6 of the Law of Ukraine “On Remuneration of Labour” dated March 24, 1995 № 108/95-VR as amended by the Law of Ukraine “On Amendments to Certain Legislative Acts of Ukraine” dated December 6, 2016 № 1774-VIII, Article 96.6 of the Labour Code of Ukraine as amended by the Law of Ukraine “On Amendments to Certain Legislative Acts of Ukraine” dated December 6, 2016 № 1774-VIII;

• 46 People's Deputies of Ukraine regarding the constitutionality of the Resolution of the Cabinet of Ministers of Ukraine “On the Implementation of the Pilot Project “National Operator in the Tobacco Products Market”” dated September 9, 2020 № 840.

• 51 People’s Deputies of Ukraine regarding the constitutionality of the provisions of Article 4.1.6, Article 11.3 of the Law of Ukraine “On Voluntary Association of Territorial Communities”.

Consideration of these cases will be continued at the next plenary sessions.

In addition, we inform that the Grand Chamber of the Constitutional Court of Ukraine considered the issue of changing the form of consideration of the case upon the constitutional petition of 48 People’s Deputies of Ukraine regarding the constitutionality of certain provisions of the Commercial Code of Ukraine, the Law of Ukraine “On Management of State Property”, requirements for an independent member of the Supervisory Board of state unitary enterprise and business company, in the authorised capital of which more than 50 percent of shares (stakes) belong to the state, approved by Resolution of the Cabinet of Ministers of Ukraine dated March 10, 2017 № 142, the Procedure for Supervisory Boards of state unitary enterprises and those participating in the general meeting and are elected to the supervisory boards of companies in the authorised capital of which more than 50 percent of shares (stakes) belong to the state, approved by the Resolution of the Cabinet of Ministers of Ukraine dated March 10, 2017 № 143. The respective issue was adjourned.
