The Grand Chamber and the Board of Judges held sessions: 4 rulings adopted

On Thursday, October 26, 2023, the Grand Chamber at the in-camera part of the plenary session proceeded with deliberation of the case upon the constitutional petition of 51 People's Deputies of Ukraine regarding the constitutionality of the provisions of Article 4.1.6, Article 11.3 of the Law of Ukraine “On Voluntary Unification of Territorial Communities”.

The Court will proceed with its deliberation at one of the next plenary sessions.

Also at the session, the Grand Chamber extended until November 23 the deadline for the adoption by the board of judges of the Court of the ruling to initiate or to refuse to initiate constitutional proceedings in the case upon constitutional complaint of Konstiantyn Mykhaylov.

On the same day, sessions of the boards of judges of the First and Second Senates took place, at which judges deliberated the issue of initiating constitutional proceedings in cases upon constitutional complaints.

Based on the results of the deliberation, the board of judges initiated constitutional proceedings in cases upon constitutional complaints of:

- Petro Kontorskyi regarding the constitutionality of Article 4.2.1.7, Article 8.1 of the Law of Ukraine “On Court Fees” No. 3674-VI dated July 8, 2011 as amended by the Law of Ukraine “On Amendments to the Commercial Procedure Code of Ukraine, the Civil Procedure Code of Ukraine, the Code of Administrative Procedure of Ukraine and other legislative acts” No. 2147-VIII dated October 3, 2017;

- Bohdan Panchenko regarding the constitutionality of the provisions of Article 51.1.9, paragraph 5-1.1 of Section XIII “Transitional Provisions” of the Law of Ukraine “On the Prosecution Office” No. 1697-VII dated October 14, 2014.

Issues related to constitutional proceedings in these cases will be deliberated by the judges at the session of the Second Senate.

At the same time, the board of judges refused (not unanimously) to initiate constitutional proceedings in the case upon the constitutional complaint of Yevhenii Drebitko regarding the constitutionality of Article 115.1.2 of the Criminal Procedure Code of Ukraine. The judges will deliberate the issue of initiating constitutional proceedings in this case at a session of the First Senate.
