The First Senate has commenced consideration of the case on the constitutionality of legislative provisions regarding the grounds for expulsion of a higher education student for breach of contract

On 1 May 2024, the First Senate of the Constitutional Court of Ukraine, at the public part of the plenary session, commenced consideration of the case upon the constitutional complaint of Volodymyr Padierin in the form of written proceedings.

The applicant requests the Court to examine the constitutionality of Article 46.1.5 of the Law of Ukraine “On Higher Education” No. 1556-VII dated 1 July 2014, according to which the grounds for expulsion of a higher education student are, in particular, ‘violation of the terms of the agreement (contract) concluded between the higher education institution and the student or the individual (legal entity) paying for such training’ (paragraph 5 of Article 46.1).

The Judge-Rapporteur in the case is Oksana Hryshchuk.

During the plenary session, the Court decided to postpone the consideration of the case due to the absence of the subject of the constitutional complaint, Volodymyr Padierin and/or his representative, Mykyta Yevstifeiev.

Therefore, the Court adjourned the case.
