The First Senate Examined the Case upon the Constitutional Complaint of Volodymyr Niekrylov

Today, on May 10, 2023, the First Senate in the public part of the plenary session in the form of written proceedings deliberated the case upon the constitutional complaint of Volodymyr Niekrylov.

According to the judge-rapporteur in the case, Petro Filiuk, Volodymyr Nekrylov applied to the Constitutional Court of Ukraine to check the compliance of paragraph 2 Section I of the Law of Ukraine "On Amendments to the Law of Ukraine "On the Status and Social Protection of Citizens Affected by the Chornobyl Disaster" regarding the increase in the level of pension provision for certain categories of persons" of June 29, 2021 No. 1584-IX (hereinafter – the Law No. 1584) and paragraph three of Article 54 Law of Ukraine "On Amendments to the Law of Ukraine "On the Status and Social Protection of Citizens Affected by the Chornobyl Disaster" of 28 February 1881 No. 796-XII as amended (hereinafter – the Law No. 796) according to which a minimum amount of pension related to invalidity which arose as a result of mutilation or illness caused by Chornobyl catastrophe with the provisions of paragraphs 2 and 3 of Article 22 and Article 64.1 of the Constitution.

According to the complainant, the amendments made by the Law No. 1584 to the Law No. 796 led to a narrowing of the scope of human and civil rights and freedoms, namely the right to social protection, which is inadmissible.

The judge-rapporteur also informed that another case with the same subject matter of appeal was pending before the First Senate.

The First Senate examined the case file in the public part of the plenary session and proceeded to the in-camera part for decision-making.

The session was attended by the subject of the right to constitutional complaint, Volodymyr Niekrylov, and the Permanent Representative of the Verkhovna Rada of Ukraine to the Constitutional Court of Ukraine Maksym Dyrdin.
