February 15. Sessions of the First Senate and Boards of Judges Were Held: 4 Rulings Adopted

On Wednesday, February 15, at the in-camera part of the plenary session the First Senate proceeded with deliberation of the case upon the constitutional complaint of Mykola Kostina regarding the constitutionality of the separate provision of paragraph 26 of Section VI “Final and Transitional Provisions” of the Budget Code of Ukraine. The Court will proceed with its deliberation at one of the next plenary sessions.

In addition, sessions of the boards of judges were also held, at which the judges deliberated issues related to the initiation of constitutional proceedings and the initiation of constitutional proceedings in cases upon constitutional complaints.

In particular, the First Board of Judges of the First Senate adopted the rulings (final) on refusal to initiate constitutional proceedings in the cases upon the constitutional complaints of:

– Limited Liability Company “Mechanical Foundry Plant” on the constitutionality of Article 13.5 of the Law of Ukraine “On Currency and Currency Operations”;

– Vitalii Pidopryhora on the constitutionality of the provisions of Article 256, Article 267.4 of the Civil Code of Ukraine in a systemic connection with the prescriptions of Article 268.1.4 of the Civil Code of Ukraine in the wording before the amendment by the Law of Ukraine “On Amendments to Certain Laws of Ukraine on Improving the Procedure Administration of Justice”.

The Second Board of Judges of the First Senate adopted the rulings (final) on refusal to initiate constitutional proceedings in the cases upon the constitutional complaints of:

– Vitalii Yarusevych on the constitutionality of the paragraph 43.1 of  Section XV “Final Provisions” of the Law of Ukraine “On Mandatory State Pension Insurance”;

– Yaroslav Kuzyk on the constitutionality of the second sentence of the first paragraph of Article 87.3 of the Law of Ukraine “On Civil Service” of December 10, 2015 No. 889-VIII as amended by the Law of Ukraine “On Amending the Customs Code of Ukraine and Some Other Legislative Acts of Ukraine in Connection with the Implementation of Administrative Reform” of January 14, 2020 No. 440-IX.
