The delegation of the Constitutional Court of Ukraine paid a working visit to the Republic of Latvia

On September 21-22, the Judges of the Constitutional Court of Ukraine Viktor Gorodovenko, Oksana Hryshchuk, Oleh Pervomaiskyi, Petro Filiuk and Galyna Yurovska were in Riga, where they participated in the International Conference “The Role of the Judiciary in the Execution of Judgements of the European Court of Human Rights”.

The event, which was co-organised by the Constitutional Court and the Supreme Court of the Republic of Latvia within the framework of the presidency of the Republic of Latvia in the Committee of Ministers of the Council of Europe, took place on September 21, 2023. The event brought together presidents and judges of bodies of constitutional jurisdiction, supreme courts, and courts of general jurisdiction of foreign countries, representatives of state bodies of power of the Republic of Latvia, international organisations and institutions, scientific and academic establishments.

Three plenary sessions were held during the Conference. At the invitation of the Constitutional Court of the Republic of Latvia and the Supreme Court of the Republic of Latvia, judges of the Constitutional Court of Ukraine participated in these sessions.

In particular, the judges of the Constitutional Court of Ukraine Petro Filiuk and Galyna Yurovska joined the work of session “Res judicata and reopening of proceedings after ECtHR judgments and the role of the ECtHR in the supervision of the execution of its judgments”, moderated by Kanstantsin Dzehtsiarou, Professor in Human Rights Law at the University of Liverpool. The parallel session on the topic “Supervision of national measures of execution of judgments of ECtHR and separation of powers; national constitutional identity as obstacle to execution”, moderated by Başak Çalı, Professor of International Law at the Hertie School, was attended by the judges of the Constitutional Court of Ukraine Viktor Gorodovenko, Oksana Hryschuk and Oleh Pervomaiskyi.

Staying in Latvia the judges of the Constitutional Court of Ukraine held bilateral meetings with colleagues from the Constitutional Court of the Republic of Latvia.

On Friday, September 22, the delegation of the Constitutional Court of Ukraine visited the Constitutional Court of the Republic of Latvia, where they held a meeting with its President Aldis Lavinš. Vice President of the Constitutional Court of the Republic of Latvia Irēna Kucina and judges of the Court Gunārs Kusiņš, Jānis Neimanis, Artūrs Kučs, Anita Rodiņa and Jautrīte Briede also took part in the meeting.

During the bilateral meeting, the participants discussed the crucial issues facing the bodies of constitutional jurisdiction in the new conditions, and exchanged opinions on a wide range of issues of constitutional justice.

In particular, judge of the Constitutional Court of Ukraine Oksana Hryshchuk delivered a presentation on “European legal values in the legal positions of the Constitutional Court of Ukraine”. Judge of the Constitutional Court of Ukraine Halyna Yurovska informed about the application of the case law of the European Court of Human Rights by the Constitutional Court of Ukraine. The judge of the Constitutional Court of the Republic of Latvia Jānis Neimanis spoke on behalf of foreign colleagues.

Judge of the Constitutional Court of Ukraine Viktor Gorodovenko presented a report to the participants of the meeting on the topic “Application of digital technologies and artificial intelligence in constitutional judicial proceedings”. The President of the Constitutional Court of the Republic of Latvia, Aldis Lavinš, also expressed his vision regarding the mentioned issue.

During the visit, the judges of the Constitutional Court of Ukraine spoke about the activities of the Constitutional Court of Ukraine under martial law, noting that the Court continues to fulfil its constitutional powers. In addition, foreign colleagues were briefly informed about the Court's decisions, delivered after the full-scale invasion of the Russian Federation into the territory of Ukraine.
