The Court Held Sessions: Cases Deliberated, a Resolution and Rulings Adopted

On Tuesday, 9 April 2024, at the in-camera parts of the plenary sessions the Grand Chamber proceeded with deliberation of cases upon constitutional petitions of:

- the Supreme Court on the constitutionality of Article 34.1.11, paragraph 10-1 of Section XIII “Final and Transitional Provisions” of the Law of Ukraine “On Enforcement Proceedings” No. 1404-VIII dated June 2, 2016, paragraphs 5-1, 5-2 of Section III “Transitional and Final Provisions” of the Law of Ukraine “On Peculiarities of Formation of a Joint Stock Company of Public Railway Transport” No. 4442-VI dated 23 February 2012;

- 48 People’s Deputies of Ukraine on the constitutionality of certain provisions of the Commercial Code of Ukraine, the Law of Ukraine “On Management of State-Owned Property”, requirements for an independent member of the supervisory board of a state unitary enterprise and a business company in which the state holds more than 50 per cent of shares (stakes), approved by Resolution of the Cabinet of Ministers of Ukraine No. 142 dated March 10, 2017, the Procedure for Determining and Approving Candidates for State Representatives Appointed to Supervisory Boards of State Unitary Enterprises and for Participating in General Meetings and Being Elected to Supervisory Boards of Business Companies in Which the State Owns More than 50 Percent of Shares (Stakes) in the Charter Capital, approved by Resolution of the Cabinet of Ministers of Ukraine No. 143 dated March 10, 2017;

- 53 People’s Deputies of Ukraine on the constitutionality of the Law of Ukraine “On amendments to the Rules of Procedure of the Verkhovna Rada of Ukraine on countering the abuse of the rights of People's Deputies of Ukraine during the legislative procedure”.

The Court will proceed with their deliberation at one of the following plenary sessions.

The Grand Chamber extended until 7 May this year the deadline for the Second Board of Judges of the Second Senate to rule on initiation or refusal to initiate constitutional proceedings in the case upon the constitutional complaint of Mykhailo Kalancha.

The Grand Chamber also deliberated the application of the Permanent Representative of the Verkhovna Rada of Ukraine to the Constitutional Court of Ukraine Maksym Dyrdin on the recusal of the Judge of the Constitutional Court of Ukraine Serhiy Holovaty in the case upon the constitutional complaint of Oleksandr Tretiak regarding the constitutionality of Article 30.6 of the Code of Ukraine on Administrative Offences and dismissed it.

In addition, the Court held a session at which the judges adopted a Resolution on approval of the text of the Annual Information Report of the Constitutional Court of Ukraine for 2023.

A special plenary session of the Court was also held, at which the judges adopted the Resolution on Amendments to the Rules of Procedure of the Constitutional Court of Ukraine.
