The Court deliberated cases upon constitutional petitions. The board of judges adopted two rulings (October 17, 2023)

On Tuesday, October 17, 2023, the Grand Chamber, at the in-camera part of the plenary sessions, proceeded with deliberation of cases upon constitutional petitions of:

- 50 People's Deputies of Ukraine regarding the constitutionality of paragraphs 3, 4 of Section II “Final and Transitional Provisions” of the Law of Ukraine “On Amendments to Certain Legislative Acts of Ukraine Regarding Ensuring Constitutional Principles in the Fields of Energy and Communal Services”, some decrees of the President of Ukraine;

- 46 People's Deputies of Ukraine regarding the official interpretation of the provisions of Article 13.1.1 and Article 14.1 of the Constitution of Ukraine.

The Court will proceed with their deliberation at one of the next plenary sessions.

The Grand Chamber at the session extended until November 16 the deadline for the adoption by the boards of judges of the Constitutional Court of Ukraine of rulings on initiating or refusing to initiate constitutional proceedings in cases upon the constitutional complaints of Yevgenii Drebitko and the Religious Community (parish) of St. Nicholas of the Ukrainian Greek-Catholic Church of the village of Viktoriv, Halytskyi District, Ivano-Frankivsk Region.

On the same day, sessions of the boards of judges of the First and Second Senates took place, at which judges deliberated the issue of initiating constitutional proceedings in cases upon constitutional complaints.

Upon the results of deliberation, the board of judges initiated a constitutional proceeding in the case upon the constitutional complaint of Oksana Tymoshenko regarding the constitutionality of a specific provision of Article 361.5.1 of the Code on Administrative Procedure of Ukraine.

At the same time, the boards of judges refused to initiate constitutional proceedings in the cases upon the constitutional complaints of Serhii Pantielieiev regarding the constitutionality of subparagraphs 1-14 of paragraph 6.4 of Section II “Final and Transitional Provisions” of the Law of Ukraine “On Measures to Ensure Legislative Support for the Reform of the Pension System” No. 3668-VI dated July 8, 2011 and Article 86.1 of the Law of Ukraine “On the Prosecution Office” No. 1697-VII dated October 14, 2014 and Diana Sherman regarding the constitutionality of a specific provision of subparagraph “a” of Article 34.6.2 of the Law of Ukraine “On State Registration of Legal Entities, Individuals-Entrepreneurs and Public Organizations” No. 755-IV dated May 15, 2003 as amended by the Law of Ukraine “On Amendments to Certain Legislative Acts of Ukraine Regarding Improvement of State Registration of Real Property Rights and Protection of Property Rights” dated October 6, 2016 No. 1666-VIII.”
