The Court began consideration of the case on the constitutionality of the Decree of the President of Ukraine on the appointment of the Director of the National Anti-Corruption Bureau of Ukraine

On July 9, the Grand Chamber of the Constitutional Court of Ukraine began consideration of the case on the constitutional petition of 51 People’s Deputies of Ukraine on the constitutionality of the Decree of the President of Ukraine "On appointing of Artem Sytnyk as the Director of the National Anti-Corruption Bureau of Ukraine" of April 16, 2015 № 218/2015 (hereinafter - the Decree) at the public part of the plenary session in the form of written proceedings.

The plenary session was chaired by the Chairman of the Constitutional Court of Ukraine Oleksandr Tupytskyi, who is the Judge-Rapporteur in the case.

He said that the subject of the right to constitutional petition appealed to the Constitutional Court of Ukraine to declare the Decree inconsistent with the Constitution of Ukraine. The People's Deputies of Ukraine consider that the issuance of the Decree contradicts the provisions of Articles 5.4, 6.2, 8.2, 19.2, 106.1.31 of the Basic Law of Ukraine. According to the petitioners, the President of Ukraine, acting outside his constitutional powers, appointed the Director of the National Anti-Corruption Bureau of Ukraine, however, this position is not included in the list of positions which could be appointed by the President of Ukraine.

The Judge-Rapporteur also noted that in order to ensure a full and objective consideration of the case and the Court’s reasoned decision, inquiries were sent to the President of Ukraine and the Chairman of the Verkhovna Rada of Ukraine to clarify their positions on issues raised in the constitutional petition.

After examining the case files in the public part of the plenary session, the Grand Chamber of the Constitutional Court of Ukraine proceeded to the in-camera part for a decision.

The plenary session of the Grand Chamber of the Constitutional Court of Ukraine was attended by the Permanent Representative of the Verkhovna Rada of Ukraine to the Constitutional Court of Ukraine Olha Sovhyria.
