On June 26, 2024, the First Senate, at the public part of the plenary session, initiated the deliberation upon the constitutional complaint of Volodymyr Yakimenko in the form of written proceedings. The applicant appeals to the Court to verify the compliance of Article 423.1 of the Civil Procedure Code of Ukraine, according to which “a court decision, resolution or ruling that has completed the deliberation of a case and entered into force may be reviewed due to newly discovered or exceptional circumstances” with the Constitution of Ukraine.

Due to the fact that the subject of the constitutional complaint was absent at the plenary session and did not inform about the reasons for his absence, the Court adjourned the deliberation of this case. Its deliberation will be proceeded at one of the next plenary sessions.

The judge-rapporteur in this case is Olga Sovgyria.

The video recording of the plenary session is available on the official website of the Constitutional Court of Ukraine in the Section “Archive of video broadcasts of the sessions” at: https://ccu.gov.ua/kategoriya/2024.
