A Constitutional petition on constitutionality of specific provisions of the Law of Ukraine
“On Voluntary Amalgamation of Territorial Communities”

On October 19, 2020 the Court was seized with the constitutional petition of 51 People’s Deputies of Ukraine on conformity of the provisions of Articles 4.1.6 and 11.3 of the Law of Ukraine “On Voluntary Amalgamation of Territorial Communities” to the Constitution of Ukraine.

The subject of the right to the constitutional petition considers that the disputed Law does not conform to a number of articles of the Basic Law of Ukraine, and „its application leads to the violation of the fundamentals of the organisation of local self-government in Ukraine guaranteed by the Constitution and the limitation of the right of the territorial communities to voluntary amalgamation“.
