A Constitutional Petition on the Compliance of the Agreement between Ukraine and the Russian Federation on the Presence of the Russia's Black Sea Fleet on the Territory of Ukraine with the Constitution of Ukraine Filed with the Constitutional Court

On March 31, 2023, a constitutional petition of 49 People's Deputies of Ukraine on the compliance of the Agreement between Ukraine and the Russian Federation on the Presence of the Black Sea Fleet of the Russian Federation on the Territory of Ukraine of April 21, 2010, ratified by the Law of Ukraine No. 2153-VI of April 27, 2010 "On Ratification of the Agreement between Ukraine and the Russian Federation on the Presence of the Black Sea Fleet of the Russian Federation on the Territory of Ukraine" (hereinafter - the Agreement) with the Constitution of Ukraine was filed with the Constitutional Court of Ukraine.

The subject of the right to constitutional petition argues that the challenged Agreement does not comply with Article 17.7 of the Basic Law of Ukraine, and also claims that the said Agreement contradicts the principles of national security. In addition, the People’s Deputies of Ukraine point out that there is no legal framework for concluding an international agreement of such nature. Therefore, in the opinion of the subject of the right to constitutional petition, there are grounds for declaring the Agreement unconstitutional.
