Chairman of the Constitutional Court of Ukraine Yurii Baulin took part in the 3rd Congress of the World Conference on Constitutional Justice

 

         Chairman of the Constitutional Court of Ukraine Yurii Baulin took part in the 3rd Congress of the World Conference on Constitutional Justice “Constitutional Justice and Social Integration”, held in Seoulб, Republic of Korea on 28 September – 1 October 2014.

         During the opening ceremony of the 3rd Congress President of the Constitutional Court of the Republic of Korea Park Han-Chul noted that it was the topmost forum of the constitutional justice in the world which promotes strengthening of the highest constitutional values. The ceremony was attended by the presidents and judges of the bodies of constitutional jurisdiction from almost 100 countries of the world, representatives of the UNO, Council of Europe, African Court on Human and Peoples' Rights, International Criminal Court, Central American Court of Justice and numerous international human rights organisations.

         President of the Republic of Korea Park Geun-Hye took part in the opening ceremony of the 3rd Congress. According to her, “the constitutional justice is the main tool in strengthening the constitutional values that plays a key role in regulation and prevention of political, social and other conflicts”. She also emphasized the significant role of the international standards in promotion of the rule of law.

         The participants were welcomed by the Secretary General of the UNO Ban Ki-Moon (via video) and the President of the Venice Commission of the Council of Europe Gianni Buquicchio.

         Speaking at the plenary session, dedicated to stocktaking of the independence of constitutional courts, Chairman of the Constitutional Court of Ukraine Yurii Baulin stated that during its activity the Constitutional Court of Ukraine had felt the urgency of judicial independence several times. Sometimes bodies of the constitutional jurisdiction from different parts of the world face similar problems. Yurii Baulin was convinced that such cases should acquire international resonance, and “World Conference on Constitutional Justice should develop mechanisms of reacting to violations of independent judiciary in the countries where they occur”.

         In addition to that Chairman of the Constitutional Court of Ukraine said that the Venice Commission had repeatedly paid attention to the necessity to respect the independence of judiciary, noting the fundamental role of the constitutional court as the guarantor of the constitutional order in state and fundamental rights. The same position was shared by theParliamentary Assembly of the Council of Europe, which in its Resolution of April 19, 2007underlined that the authority of the sole body of constitutional justice should be guaranteed and respected, and pressure on judges in any form is unacceptable.

         “Members of the constitutional community help each other in difficult times. Our voice becomes more significant both on the national and international levels when we stand together to defend principles which everybody of us practices: independence of the judiciary, rule of law, human rights and democracy”, stress Chairman Baulin.

         Yurii Baulin also made a contribution at the plenary session “Challenges of social integration in a globalised world” where he drew attention to such an important direction of activity of the Constitutional Court of Ukraine as harmonisation of interests of citizens and public interests to prevent uncontrolled, unreasonable rejection of the guaranteed measures of social protection and at the same time taking into consideration economic and financial resources of the state.

         It is also worth mentioning that the principles of post-Soviet state, including in social sphere, had formed consuming thinking, which require time to be changed, not at once but gradually. So the reply to challenges of social integration is only possible on a new, more effective level of social relations in various spheres of public life, with account of balance between private, public and state interests.

         During the Congress regional and linguistic groups which are members of the World Conference on Constitutional Justice also held their meetings. Chairman of the Constitutional Court of Ukraine took part in the meeting of the Conference of European Constitutional Courts, where preparation for the XVII Congress of the Conference of European Constitutional Courts to be held in Batumi (Georgia) in 2017 was discussed.

         Yurii Baulin also participated in the meeting of the Conference of Constitutional Control Organs of the Countries of New Democracy where he came forward with an initiative to expand scientific and practical cooperation of constitutionalists within this organisation, in particular inviting members of the Conference to participate in activities of “The Bulletin of the Constitutional Court of Ukraine” and provide publications for its column “Constitutionalism of foreign countries”.

         During the visit, Yurii Baulin held a number of official meetings and working contacts, in particular along with other members of theCongress he took part in the meeting with the Prime Minister of the Republic of Korea Jung Hong-Won. Chairman of the Constitutional Court of Ukraine also met with the President of the Constitutional Court of the Republic of Korea Park Han-Chul, with whom he discussed the perspective directions of bilateral cooperation between the Constitutional Courts of Ukraine and the Republic of Korea.

         Chairman Baulin also held a number of fruitful meetings with colleagues – presidents of bodies of constitutional jurisdiction of Azerbaijan,Bulgaria, Georgia, Kazakhstan, Kyrgyzstan, Latvia, Lithuania, Moldova, Netherlands, Poland, Romania, Slovakia, Tajikistan, Turkey, Hungary,Montenegro and Uzbekistan. In addition, Yurii Baulin met with the President of the Venice Commission Gianni Buquicchio and Ambassador Extraordinary and Plenipotentiary of Ukraine to the Republic of Korea Vasyl Marmazov.
