The Case on the Constitutionality of the Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine Concerning the Conditions of Agricultural Land Circulation" and Certain Provisions
of the Land Code of Ukraine Was Adjourned

On June 3, at the public part of the plenary session, the Grand Chamber of the Constitutional Court of Ukraine considered the motions of the participants in the constitutional proceedings - representatives of the subject of the right to a constitutional petition Serhiy Vlasenko and Vasyl Nimchenko.

The Court granted the motion of the representative of the subject of the right to a constitutional petition, People's Deputy of Ukraine Serhiy Vlasenko to include in the case file an analytical report of GROWFORD Institute ‘Land Market: Existing Threats to Ukraine and Necessary Safeguards’ (September 2019) and denied the motion of the representative of the subject of the right to a constitutional petition, the People's Deputy of Ukraine Vasyl Nimchenko on the recusal of the Judge of the Constitutional Court of Ukraine Serhiy Holovaty from consideration of this case.

To resolve procedural issues related to the rest of the motions, the Court adjourned the case upon the constitutional petitions of 48 People's Deputies of Ukraine on the compliance with the Constitution of Ukraine of the Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine Concerning the Conditions of Agricultural Land Circulation" and certain provisions of the Land Code of Ukraine as amended by this law, as well as of 53 People's Deputies of Ukraine on the constitutionality of the Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine Concerning the Conditions of Agricultural Land Circulation".

The date and time of the next plenary session will be announced additionally.

The plenary session was attended by representatives of the subject of the right to a constitutional petition, MPs of Ukraine Yuliia Tymoshenko, Serhiy Vlasenko, Vasyl Nimchenko, Nataliia Korolevska, Permanent Representative of the Verkhovna Rada of Ukraine to the Constitutional Court of Ukraine Olha Sovhyria, Representative of the President of Ukraine to the Constitutional Court of Ukraine Fedir Venislavskyi.

The session was also attended by participants of the constitutional proceedings: Chairman of the Verkhovna Rada Committee on Agrarian and Land Policy, People's Deputy of Ukraine Mykola Solskyi, Commissioner of the President of Ukraine for Land Affairs - Minister of Agrarian Policy and Provision of Ukraine Roman Leshchenko, Verkhovna Rada Commissioner for Human Rights Liudmyla Denisova, Director of the National Research Center "Institute of Agrarian Economics", Doctor of Economics, Professor, Full Member of the National Academy of Agrarian Sciences of Ukraine Yuriy Lupenko, Deputy Director for Research and Project Activities of the National Research Center "Institute of Agrarian Economics", Doctor of Economics Olha Khodakivska, Head of the Department of Land and Agrarian Law, Faculty of Law of the Taras Shevchenko National University of Kyiv, Doctor of Law Volodymyr Nosik, Professor of Land and Agrarian Law Faculty of Taras Shevchenko National University of Kyiv, Doctor of Law Anatoliy Miroshnychenko, President of the Association of Farmers and Private Landowners of Ukraine Mykola Stryzhak and member of the Research Advisory Council of the Constitutional Court of Ukraine, retired Judge of the Constitutional Court of Ukraine Viktor Shyshkin.
