The Assembly of the Research Advisory Council of the Constitutional Court of Ukraine and scientific and practical conference took place at the Constitutional Court of Ukraine
On October 28, the second assembly of the Research Advisory Board of the Constitutional Court of Ukraine and the scientific and practical online conference “Doctrinal Approaches in the Activity of the Constitutional Court of Ukraine” were held in the Constitutional Court of Ukraine which was organised with the support of the OSCE Project Co-ordinator in Ukraine.
The assembly discussed practical issues of cooperation between the Constitutional Court of Ukraine and the Research Advisory Council of the Constitutional Court of Ukraine, as well as forms and formats of cooperation within the Council.
The Judge of the Constitutional Court of Ukraine, Chairman of the Standing Commission on Scientific Support of the Constitutional Court of Ukraine, Doctor of Legal Sciences, Professor, Corresponding Member of the National Academy of Legal Sciences of Ukraine Viktor Kolisnyk welcomed the participants and outlined the issues to be addressed.
According to him, the main purpose of the Research Advisory Council of the Constitutional Court of Ukraine is to prepare research opinions to facilitate the full and comprehensive consideration of cases by the body of constitutional jurisdiction of Ukraine.
He focused the attention of the participants on the forms of cooperation between members of the Research Advisory Council of the Constitutional Court of Ukraine and judges of the Constitutional Court of Ukraine in common research areas in the process of drafting research opinions on the activities of the Court.
Issues decided by the Constitutional Court of Ukraine require in-depth theoretical and practical knowledge in various fields of law, so the Court's activities require thorough scientific support.
Viktor Kolisnyk noted that during the preparation of the expert opinion, a member of the Scientific Advisory Board may present his/her own opinion, position, methodology to resolve a certain issue, or may cooperate with other Research Advisory Council of the Constitutional Court of Ukraine members and judges, etc. He stressed the importance of cooperation and interaction both within the Council and with the judges of the Constitutional Court. In this context, the judge of the Constitutional Court of Ukraine informed the audience about the possible and appropriate formats of such interaction.
In turn, Yurii Barabash, Chairman of the Research Advisory Council of the Constitutional Court of Ukraine, Doctor of Legal Sciences, Professor, Corresponding Member of the National Academy of Legal Sciences of Ukraine, Vice-Rector for Academic Affairs of the Yaroslav Mudryi National Law University, drew attention to the issues of formats of interaction between members of the Research Advisory Council of the Constitutional Court of Ukraine and judges of the Constitutional Court of Ukraine. In particular, in his speech he outlined possible forms of cooperation between members of the Council and judges of the Constitutional Court of Ukraine.
The participants of the meeting joined the discussion of the issues raised and expressed their views on their solution.
Within the framework of the Research Advisory Council of the Constitutional Court of Ukraine assembly, a scientific and practical online conference “Doctrinal Approaches in the Activity of the Constitutional Court of Ukraine” was held. Judges of the Constitutional Court of Ukraine, former judges of the Court, leading domestic scholars and international experts participated in it.
During the three thematic sessions, participants discussed the topics: “The doctrine of separation of powers: modern contexts”, “Principles of the welfare state and protection of human dignity: interpenetration and guarantee system”, “Rule of law as an instrument of constitutional protection of human rights”.
Judges of the Constitutional Court of Ukraine Serhiy Holovaty, Viktor Horodovenko, Vasyl Lemak, Halyna Yurovska, Team Leader of EU Pravo-Justice Project Dovidas Vitkauskas, the Head of Division of the Department for the Execution of Judgments of the ECtHR of the Directorate General for Human Rights and Rule of Law of the Council of Europe Pavlo Pushkar, Project Manager of the Venice Commission of the Office of the Council of Europe in Ukraine Serhiy Tkachenko were moderators of the event.
The participants noted the benefits of the discussion and stressed the effectiveness of such dialogues.
