2 March. The Court’s Agenda (Approved). Sessions of the Grand Chamber and the Boards of Judges Were Held

Today, March 2, the Grand Chamber at the in-camera part of the plenary session continued to deliberate the case upon the constitutional petition of 51 People's Deputies of Ukraine regarding the official interpretation of the provisions of Articles 7, 20.7, 92.1.12, 92.1.15, 92.1.16, 118.1, 118.2, 118.3, 118.4, 118.5, 133.2, 140.1, 140.2, 140.3, 140.4, 141.2 and 141.4 of the Constitution of Ukraine. The Court will continue its examination at one of the forthcoming plenary sessions.

At the session of the Grand Chamber, the judges considered the issue of determining the form of constitutional proceedings in the cases upon the constitutional petitions.

The Court issued rulings on consideration of the case oupn the constitutional petition of the Supreme Court regarding the constitutionality of paragraph 11 of Article 34.1, paragraph 101 of Section XIII "Final and Transitional Provisions" of the Law of Ukraine "On Enforcement Proceedings", paragraphs 51, 52 of Section III "Transitional and Final Provisions" of the Law of Ukraine "On Peculiarities of Establishment of a Joint Stock Company of Public Railway Transport" in the form of written proceedings, and in the case upon the constitutional petition of 99 People’s Deputies of Ukraine regarding the official interpretation of Article 4 of the Constitution of Ukraine – in the form of oral proceedings.

The Grand Chamber also adopted rulings extending until March 30 the term for the Third Board of Judges of the Second Senate and the Third Board of Judges of the First Senate to adopt rulings on initiating or refusing to initiate the constitutional proceedings in the cases upon constitutional complaints of O. Parkhomenko and B. Chehil.

On the same day, session of the Second Senate and the boards of judges were held.

At the plenary session, the Second Senate continued to deliberate the case upon the constitutional complaints of Serhii Syrotenko regarding the constitutionality of certain provisions of Articles 171.9.2 and 246.5.4 of the Code of Administrative Proceeings of Ukraine. The Court will continue its consideration at one of the forthcoming plenary sessions.

The Second Board of Judges of the First Senate issued a Ruling (final) on refusal to initiate constitutional proceedings in the case upon the constitutional complaint of Olena Drahan regarding the constitutionality of paragraphs 6, 7.1 and 19.1 of Section II "Final and Transitional Provisions" of the Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine on Priority Measures for the Reform of the Prosecution Bodies" of September 19, 2019 No. 113-IX as amended by the Law of Ukraine "On Amendments to Section II "Final and Transitional Provisions" of the Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine on Priority Measures for the Reform of the Prosecution Bodies" regarding certain aspects of the effect of transitional provisions" of June 15, 2021 No. 1554-IX.

The Second Board of Judges of the Second Senate issued a Ruling (final) refusing to initiate constitutional proceedings in the case upon the constitutional complaint of Yevhen Matvieienko regarding the constitutionality of Article 2 of the Law of Ukraine "On Measures to Legislatively Ensure the Reform of the Pension System" of July 8, 2011 No. 3668-VI, Article 86.15 of the Law of Ukraine "On the Prosecution Office" of October 14, 2014 No. 1697-VI.

Furthermore, a special plenary session of the Constitutional Court of Ukraine was held, at which the judges continued to examine the appeal of the former judge of the Constitutional Court of Ukraine Stanislav Shevchuk. The deliberation was held.
