17 November. The Court Agenda (Approved). The Plenary Sessions of the First and Second Senates: Consideration of the Cases upon the Constitutional Complaints

Wednesday, 17 November, the Fist Senate of the Constitutional Court of Ukraine, at the public part of the plenary session in the form of written proceedings, considered the following cases:

  • upon the constitutional complaint of Mykola Kostina on conformity of the specific provision of clause 26 of Section VI “Final and Transitional Provisions“ of the Budget Code of Ukraine to the Constitution of Ukraine;
  • upon the constitutional complaint of Hanna Raikun on conformity of the provisions of Article 2 of the Law of Ukraine “On Measure Regarding the Legislative Ensuring the Pension System Reform“ of 8 July 2011 No. 3668-VІ, the first sentence of Article 86.15.6 of the Law of Ukraine “On the Prosecution Office” of 14 October 2014 No. 1697-VІІ to the Constitution of Ukraine;
  • upon the constitutional complaint of Serhiy Trutniev on conformity  of the provisions of Article 142.1 of the Code of Administrative Offences of Ukraine to the Constitution of Ukraine.
  • Court examined the case files at the public part of the plenary session and proceeded to their examination at the in-camera part of the plenary sessions.

At the plenary session of the First Senate, a Ruling was adopted on joining constitutional proceedings in the cases upon the constitutional complaint of Antonina Bolotnikova on constitutionality of Article 86.15.6 of the Law of Ukraine “On the Prosecution Office” of 14 October 2014 No. 1697-VІІ and Article 2 of the Law of Ukraine “On Measure Regarding the Legislative Ensuring the Pension System Reform“ of 8 July 2011 No. 3668-VІ and the constitutional complaint of Hanna Raikun on conformity of the provisions of Article 2 of the Law of Ukraine “On Measure Regarding the Legislative Ensuring the Pension System Reform“ of 8 July 2011 No. 3668-VІ, snf the first sentence of Article 86.15.6 of the Law of Ukraine “On the Prosecution Office” of 14 October 2014 No. 1697-VІІ to the Constitution of Ukraine.

The Second Senate at the in-camera part of the plenary session continued to deliberate the case upon the constitutional complaint of the Joint-Stock Company “The State Savings Bank of Ukraine” on conformity of the rule of the first sentence of Article 1050.1 of the Civil Code of Ukraine to the Constitution of Ukraine. The consideration of the case will be continued at one of the next plenary sessions.
