11 July. Sessions of the Court Held: 5 Rulings Adopted

On Tuesday, July 11, 2023, at its plenary session, the Grand Chamber proceeded with the consideration of the case upon the constitutional petition of the Supreme Court of Ukraine regarding the constitutionality of the Law of Ukraine „On the Deposit Guarantee System“. The Court will proceed with its consideration at one of the forthcoming plenary sessions.

Additionally, the Grand Chamber merged into one constitutional proceeding the cases upon the constitutional complaint of Mykola Nikolayev regarding the constitutionality of the provisions of the first sentence of the sixth paragraph of Article 86.15 of the Law of Ukraine „On the Prosecutor’s Office“ of October 14, 2014, No. 1697-VII, the first sentence of Article 2, paragraph 2.2 of Section II „Final and Transitional Provisions“ of the Law of Ukraine „On Measures to Legislatively Ensure the Reform of the Pension System“ of July 8, 2011, No. 3668-VI with the constitutional complaints of Antonina Bolotnikova, Hanna Raikun, Ihor Melnychuk, Vitalii Kovbasiuk, Mykola Biliak, Antonina Yefimenko, Volodymyr Veselukha, Olena Serbina, Yurii Rozhyn, Volodymyr Parovyi regarding the constitutionality of certain provisions of Article 2, paragraph two of Section II „Final and Transitional Provisions„ of the Law of Ukraine „On Measures to Legislatively Ensure the Reform of the Pension System„ of No. 3668-VI of July 8, 2011, Article 86.2, paragraph 6 of Article 86.15 of the Law of Ukraine „On the Prosecutor’s Office„ of October 14, 2014, No. 1697-VII.

A plenary session of the Second Senate was also held, at which judges considered the case upon the constitutional complaint of Nataliia Tryhub regarding the constitutionality of Article 44.2 of the Law of Ukraine „On State Market Supervision and Control of Non-Food Products„. The Court will proceed with its consideration at one of the forthcoming plenary sessions.

The Second Senate at its session determined the written form of constitutional proceedings in cases upon the constitutional complaints of Anatolii Luzhynetskyi regarding the constitutionality of certain provisions of Article 111.1 of the Criminal Executive Code of Ukraine and Oksana Bukhtoyarova regarding the constitutionality of paragraph fifteen of Article 1.1, subparagraph „c“ of paragraph 2 of Article 3.1, Article 45.1, Article 51-1.1 of the Law of Ukraine „On Prevention of Corruption“, paragraph 1 of Article 238.1 of the Code of Administrative Procedure of Ukraine.

The same day, a session of the First Board of Judges of the Second Senate was held, where judges adopted rulings (final) on the refusal to initiate constitutional proceedings in cases upon the following constitutional complaints of:

- Raisa Lazarenko regarding the compliance of paragraph 11 of Article 1.1, Article 11.3, Article 13.5 of the Law of Ukraine „On Housing and Communal Services“, Article 7.4 of the Law of Ukraine „On the Status of Veterans of Military Service, Veterans of Internal Affairs, Veterans of the National Police and Some Other Persons and Their Social Protection“ with the Constitution of Ukraine;

- „Mykola Zhuravel regarding the constitutionality of the provision of paragraph 1 of Article 371.2 of the Law of Ukraine “On State Registration of Real Property Rights and Encumbrances“.
