During the in-camera part of the plenary session the Grand Chamber deliberated the case upon the constitutional complaints of Aliona Zabara, Gagik Martirosian, Serhii Trutniev on the compliance of the provisions of Article 14².1 of the Code of Ukraine on Administrative Offenses with the Constitution of Ukraine, Nadiia Kopylova on the compliance of Article 14².1, Article 279¹.5 of the Code of Ukraine on Administrative Offenses with the Constitution of Ukraine. The Court will deliberate the case at one of the following plenary sessions.
The Grand Chamber adopted 2 rulings to extend the term until January 20, 2022, of the adoption of the ruling of the Boards of Judges of the Court on the initiation or refusal to initiate constitutional proceedings in the cases upon constitutional complaints of O.Kuzmychenko and V.Petrenko.
On the same day, at the sessions of the Boards of Judges of the First and Second Senates, the issue of initiating constitutional proceedings was deliberated in the cases upon the constitutional complaints of:
- Liubov Titkova on compliance of the provisions of Article 161.3, Article 296.5.1, Article 330.4 of the Code of Ukraine on Administrative Procedure with the Constitution of Ukraine;
- Tetiana Tereshchenko on compliance of sub-paragraph “a” of paragraph 2 of Article 389.3 of the Code of Civil Procedure of Ukraine with the Constitution of Ukraine;
- Yaroslav Hryhorenko on compliance of the provisions of Article 44³.2 of the Code of Ukraine on Administrative Offenses with the Constitution of Ukraine;
- Andrii Dubrovskyi on compliance of the provisions of Article 51.5 of the Law of Ukraine “On Prosecutor's Office”, subparagraphs one, three, six, seven of paragraph 19 of Section II “Final and Transitional Provisions” of the Law of Ukraine “On Amendments to Certain Legislative Acts of Ukraine Concerning Priority Measures to Reform the Prosecutor's Office” with the Constitution of Ukraine;
- Nataliia Kryvenko on compliance of the provisions of Article 16³.8 of the Law of Ukraine “On Social and Legal Protection of Servicemen and Members of Their Families” of December 20, 1991 No. 2011-XII, paragraph 2 of Section II “Final Provisions” of the Law of Ukraine “On Amendments to Some Laws of Ukraine on Social Protection of Servicemen” of July 4, 2012 No. 5040–VI with the Constitution of Ukraine;
- Serhiy Kovalchuk on compliance of the provisions of Article 2 of the Law of Ukraine “On Measures to Ensure the Legislative Reform of the Pension System“ with the Constitution of Ukraine.
Upon the results of the deliberation, the Boards of Judges ruled to refuse to initiate constitutional proceedings in the cases.
