On December 10, 2025, the First Senate deliberated upon the constitutional complaint of Vira Moshynska in the public part of the plenary session in the form of written proceedings.
As noted by the Judge-Rapporteur in the case, Petro Filiuk, the applicant appealed to the Constitutional Court of Ukraine to verify the compliance of Article 8.2 of the Law of Ukraine “On the State Budget of Ukraine for 2024” No. 3460-IX dated November 9, 2023 (hereinafter, the “Law”), which sets the minimum wage, used as a basis for calculating payments under court decisions, at 1,600 hryvnias. with the Constitution of Ukraine
Arguing that the contested provision of the Law is inconsistent with a number of provisions of the Constitution of Ukraine, the applicant notes that “as a result of the adoption and subsequent application of [the contested provision of the Law], the scope of social guarantees provided by the State and the amount of pension benefits for persons affected by the Chornobyl disaster, who, in accordance with the Constitution of Ukraine, have special status and additional social guarantees, have been significantly reduced”.
The Judge-Rapporteur also informed that cases with the same subject of constitutional review are pending before the First and Second Senates.
After examining the case materials in the public part of the plenary session, the Court proceeded to the in-camera deliberations for a decision.
Serhiy Potemkin, representative of the entity entitled to file a constitutional complaint, and Maksym Dyrdin, Permanent Representative of the Verkhovna Rada of Ukraine in the Constitutional Court of Ukraine, took part in the plenary session.
