The court is deliberating the case regarding the constitutionality of the provision of the Law of Ukraine "On the State Budget of Ukraine for 2025"

On 20 November 2025, during the public part of the plenary session, the Grand Chamber began deliberating the case in written proceedings based on the constitutional petition of the Supreme Court regarding the constitutionality of the fifth paragraph of part one of Article 7 of the Law of Ukraine “On the State Budget of Ukraine for 2025”.

During the plenary session, the Judge-Rapporteur in the case, Olga Sovgyria, informed that the Supreme Court had appealed to the Constitutional Court of Ukraine to verify the compliance of paragraph five of Article 7.1 of the  Law of Ukraine On the State Budget of Ukraine for 2025 dated 19 November 2024 No. 4059-IX (hereinafter, the “Law”) with Articles 6, 8, Article 126.1, Article 130 of the Constitution of Ukraine, regarding the establishment, from 1 January 2025, of a monthly subsistence minimum per person for able-bodied persons, which is used to determine the base salary of a judge, in the amount of 2,102 hryvnias.

In the opinion of the subject of the constitutional petition, the contested provision of the Law “de facto changes the legal regulation of judicial remuneration, which is defined in a special legislative act – the Law of Ukraine “On the Judiciary and the Status of Judges” dated 2 June 2016 No. 1402-VIII.

In its constitutional petition, the Supreme Court also notes that by adopting the Law, the legislator has in fact established a different (lower) amount of remuneration for judges, thereby narrowing the guarantees of judicial independence, which contradicts the provisions of Article 126.1 of the Constitution of Ukraine.

The Judge-Rapporteur informed that in order to ensure a full and objective deliberation of the case and the delivery of justified decision by the Court, he had sent requests to state authorities and scientific establishments in order to clarify scientific positions and scientific approaches to resolving the issues raised in the constitutional proceedings. The judges will be informed of the content of the positions expressed in the in-camera part of the plenary session.

After examining the case materials in the public part of the plenary session, the Court proceeded to the in-camera deliberations for a decision.

The plenary session of the Grand Chamber was attended by the representative of the subject entitled to file the constitutional petition, First Deputy Head of the Supreme Court Administration Rasim Babanly, Permanent Representative of the Verkhovna Rada of Ukraine to the Constitutional Court of Ukraine Maksym Dyrdin, and Representative of the President of Ukraine to the Constitutional Court of Ukraine Serhiy Dembovskyi.
