On 5 February 2025, the constitutional petition from 51 MPs of Ukraine was lodged with the Constitutional Court of Ukraine regarding the constitutionality of the Law of Ukraine “On De-Sovietization of the Legislation of Ukraine” No. 2215-IX dated 21 April 2022 , in terms of non-application of a number of regulatory acts of the USSR and the Ukrainian SSR in Ukraine.
The subject of the right to constitutional petition, in particular, notes that “if the rights to land plots were obtained on the basis of legislation not applicable in Ukraine and have not yet been re-registered in accordance with the legislation of Ukraine, the validity of such rights is questionable. In case such rights are challenged or not recognised, it will be difficult to defend their legitimacy, since the source of the right of their origin is not applicable in Ukraine.”
The constitutional petition is currently being processed by the Constitutional Court of Ukraine Secretariat.
