Judges of the Constitutional Court of Ukraine participated in the workshop “Civil Code in the Scientific Doctrine and Acts of the Constitutional Court of Ukraine”

Today, on 24 January 2025, an online legal workshop on the Civil Code in the Scientific Doctrine and Acts of the Constitutional Court of Ukraine was held within the framework of the Memorandum of Cooperation between the Constitutional Court of Ukraine and the Law Publishing House “Pravo Ukrainy”.

The event was attended by Judges of the Constitutional Court of Ukraine Oleg Pervomaiskyi and Galyna Yurovska, and Professor of the Department of Civil Law at Yaroslav Mudryi National Law University Inna Spasibo-Fatieieva.

In their speeches, the judges of the Constitutional Court of Ukraine highlighted the key decisions of the Court regarding the interpretation of the provisions of the Civil Code and their compliance with the Basic Law of Ukraine.

In particular, they mentioned the Decision in the case upon the constitutional appeal of citizen Oleksandr  Zaporozhetsev on the right to a mandatory share in the inheritance of adult disabled children of the testator; the Decision in the case upon the constitutional complaint of Andrii Dermenzha on the constitutionality of the provisions of parts one and two of Article 23 of the Law of Ukraine “On Mortgage”; Decision in the case upon the constitutional complaint of PJSC JSCB “INDUSTRIALBANK” regarding the constitutionality of the provisions of part three of Article 13 and part three of Article 16 of the Civil Code of Ukraine; Decision in the case upon the constitutional complaint of Kyrylo Burma regarding constitutional guarantees of the rights of individual entrepreneurs and a number of others.

Professor of the Department of Civil Law at Yaroslav Mudryi National Law University, Corresponding Member of the National Academy of Legal Sciences of Ukraine Inna Spasibo-Fatieieva pointed out the key aspects of the doctrinal understanding of the Civil Code, in particular, she focused on the historical evolution of the Code and current challenges, and noted the division of law into private and public in the context of the Civil Code.
