Constitutionalism and war: judges of the Constitutional Court of Ukraine participated in the XII Summer School of Constitutional Law

Judges of the Constitutional Court of Ukraine Oksana Hryshchuk, Vasyl Lemak, Oleksandr Petryshyn, Serhiy Riznyk, Galyna Yurovska participated in the XII Summer School “Constitutionalism and the War: From in Bello to post Bellum”, organised by the OSCE Support Program for Ukraine together with the Constitutional Court of Ukraine and the National Academy of Legal Sciences of Ukraine. The event lasted from July 28 to August 4, 2024 and brought together 30 students and postgraduates of legal establishments of higher education and academic institutions of Ukraine.

The speeches of judges of the Constitutional Court of Ukraine, experts of international organizations, judges of foreign constitutional courts, leading domestic and foreign scientists, practicing lawyers were devoted to topical issues of constitutionalism in the conditions of war and the post-war period.

Serhiy Riznyk spoke about the system of ensuring the constitutionality of normative acts in Ukraine before, during and after the war.

Oleksandr Petryshyn revealed the issue of the normative model of the constitutional complaint in Ukraine.

Galyna Yurovska's report was about the right to judicial protection in wartime.

Oksana Hryshchuk spoke about human dignity as a source of human rights and freedoms and its dimensions.

Vasyl Lemak presented a report on the topic “Effective Constitution of Ukraine as a factor of defense in the conditions of martial law”.

 

In general, the participants of this year's summer school discussed a number of topical issues, including:

  • Is it possible to hold elections under shelling? How can democratic legitimacy be ensured in times of war?
  • Human rights may be restricted under the conditions of martial law; to what extent is this permissible and how can the legality of such restrictions be assessed?
  • What threats does the war pose to the constitutional system? What safeguards does the Ukrainian constitutional system envisage to neutralise or mitigate them?
  • How does the transition from wartime constitutionalism to a postwar constitutional order look like?
  • What challenges will the process of European integration pose for the constitutional system of Ukraine?
