The Constitutional Court of Ukraine: Monthly Results
In March, 16 plenary sessions and 9 sessions of the Grand Chamber and the Senates of the Constitutional Court of Ukraine took place in the Court.
At the public parts of the plenary sessions of the Grand Chamber of the Court, in the form of written proceedings, the Court considered 4 cases upon the constitutional petitions of the Ukrainian Parliament Commissioner for Human Rights, the Supreme Court and People's Deputies of Ukraine. Having examined the materials of these cases, the Court proceeded to in-camera parts of the plenary sessions for decisions.
The Grand Chamber continued consideration of 9 cases at in-camera plenary sessions, as well as considered a number of issues at the sessions on determining the form of consideration of cases, extension of the term of adopting rulings by the Boards of Judges of the Constitutional Court of Ukraine on initiating or refusing to initiate the constitutional proceedings upon constitutional complaints and on initiating constitutional proceedings in the case upon the constitutional petition. Based on the results of their consideration, 7 rulings of the Grand Chamber of the Court were adopted.
7 plenary sessions and sessions of the Senates of the Constitutional Court of Ukraine were held during the respective period.
The consideration of the case upon the constitutional complaint was continued at the in-camera part of the plenary session of the First Senate. As a result of the session, a ruling to refuse to consider the case at the discretion of the Grand Chamber of the Constitutional Court of Ukraine was adopted.
In addition, 2 plenary sessions of the Second Senate of the of the Constitutional Court of Ukraine took place, at which the Senate proceeded with consideration of the case upon the constitutional complaint, as well as considered the case upon the constitutional complaint of the Joint-Stock Company “The State Savings Bank of Ukraine” at the public part of the plenary session in the form of written proceedings and proceeded to in-camera part for a decision.
At 4 sessions of the Second Senate 3 rulings were adopted: on initiating the constitutional proceedings in the case; on the form of consideration of the case; on the self-recusal of a judge of the Constitutional Court of Ukraine in the case.
During the respective period, 11 sessions of the Boards of Judges of the First and Second Senates of the Court were held, at which 23 rulings were adopted.
In particular, 19 final rulings on refusal to initiate constitutional proceedings in the cases upon the constitutional complaints, 1 ruling on initiating constitutional proceedings in the case upon the constitutional complaint and 2 rulings on refusal to initiate the constitutional proceedings in cases (not unanimous) upon the constitutional complaints and 1 ruling on refusal to initiate the constitutional proceedings upon the constitutional petition.
In March, 1 constitutional petition, 1 constitutional appeal and 46 constitutional complaints were filed at the Constitutional Court.
According to the results of the preliminary examination, the constitutional petition, the constitutional appeal and 19 constitutional complaints were distributed to the judges-rapporteurs. 27 complaints that did not meet the requirements of the Law of Ukraine “On the Constitutional Court of Ukraine” were returned to the subjects of the right to constitutional complaint.
The Constitutional Court of Ukraine was also seized with 70 requests for public information and 129 appeals from citizens. The Secretariat prepared 138 responses to these documents. 22 preliminary opinions were drafted (20 - upon constitutional complaints, 2 - upon the constitutional petition and the constitutional appeal).
At the same time, we would like to remind you that the Constitutional Court of Ukraine works in the mode of remote work during the period of enhanced quarantine. Judges continue to work in the sessions of the boards and commissions, as well as prepare case materials for consideration at the sessions, plenary sessions of the Senates and the Grand Chamber of the Court.
