The Constitutional Court of Ukraine stands for the protection of human and civil rights and is out of politics

The Constitutional Court of Ukraine acts exclusively in the interests of the Ukrainian people

The Constitutional Court of Ukraine serves only the Constitution of Ukraine, not political parties

According to the Constitution of Ukraine and the Law of Ukraine “On the Constitutional Court of Ukraine”, the Constitutional Court is a body of constitutional jurisdiction which ensures the supremacy of the Basic Law of Ukraine, which operates on the principles of the rule of law, independence, collegiality, publicity, openness, reasonableness and binding effect of its decisions and opinions.

Article 64 of the Law of Ukraine “On the Constitutional Court of Ukraine” stipulates that cases in which constitutional proceedings have been initiated shall be considered by the Court in written or oral procedure. The basic form of consideration of cases in the Court is written proceedings.

It is the exclusive right of the Court to decide on the determination and change of the form of consideration of a case at any stage of the constitutional proceedings. In accordance with § 49 of the Rules of Procedure of the Constitutional Court of Ukraine, the Court determines the form of constitutional proceedings at its sitting by a ruling.

By the rulings of 19 October, the Constitutional Court of Ukraine changed the form of consideration of a number of cases from oral to written due to quarantine restrictions related to the deteriorating epidemic situation in the country.

At the same time, consideration of these cases will be public, which does not lead to violation of the rights of participants in the constitutional proceedings.

Statements and allegations of certain politicians and civil servants in the media and social networks addressed to the Constitutional Court of Ukraine, which come down to accusations of “gross violation” of the rights of the President of Ukraine and the Verkhovna Rada of Ukraine are an attempt to undermine the authority of the Constitutional Court.

The Constitutional Court of Ukraine hopes that the publication posted on the official pages of the political party “Servant of the People” on social networks (https://bit.ly/3jclAOl; https://bit.ly/35iBmSS) reflects the position of individual politicians, and not the President of Ukraine and the Verkhovna Rada of Ukraine.
