filed a constitutional petition to the Constitutional Court

 

Today, on July 15, the Constitutional Court of Ukraine received a constitutional petition of 45 People’s Deputies of Ukraine on the official interpretation of Article 58.1 of the Constitution of Ukraine in conjunction with the provisions of Articles 8 and 43 of the Constitution of Ukraine, and Article 39.4 of the Law of Ukraine on Public Prosecutor’s Office dated October 14, 2014 No. 1697-VII and the provisions of the fourth subparagraph of paragraph 2 of Section II of the Law of Ukraine on Amendments to Certain Legislative Acts of Ukraine Concerning Priority Measures to Reform the Bodies of Prosecutor's Office dated September 19, 2019 No. 113-IX.

According to the petitioners, the basis of this constitutional petition is “the need to finally adjust the approach of the Constitutional Court of Ukraine on the interpretation of the concept of irreversibility of legal acts and the final formulation of the principle of irreversibility, in particular to ongoing legal relations.”

In addition, the practical need to address this constitutional petition is the legal need to determine the legitimacy of decisions and procedural documents signed by prosecutors who hold administrative positions and continue to exercise their powers after the expiration of the term for which they were appointed (given that the legislator suspended the effect of the rule of the Law, which establishes the term for which the prosecutor is appointed to an administrative position) and the establishment of legal certainty in these legal relations for the subjects of such legal relations.
